I’m not sure what is in the water coolers in the South Carolina Legislature but one must give them credit for “creativity”

CHAPTER 29.

SUBVERSIVE ACTIVITIES REGISTRATION ACT

South Carolina now requires groups and persons who intend to overthrow the United States government to register with the Secretary of State. They must file a form and pay a $5 registration fee

Section 23-29-20 of the Act

1) “Subversive organization” means every corporation, society, association, camp, group, bund, political party, assembly, body or organization, composed of two or more persons, which directly or indirectly advocates, advises, teaches or practices the duty, necessity or propriety of controlling, conducting, seizing or overthrowing the government of the United States, of this State or of any political subdivision thereof by force or violence or other unlawful means;

(2) “Organization subject to foreign control” means every corporation, society, association, camp, group, bund, political party, assembly, body or other organization, composed of two or more persons, which comes within either of the following:

(a) it solicits or accepts financial contributions, loans or support of any kind directly or indirectly from, or is affiliated directly or indirectly with, a foreign government or a political subdivision thereof, an agent, agency or instrumentality of a foreign government or political subdivision thereof, a political party in a foreign country or an international political organization or

(b) its policies, or any of them, are determined by or at the suggestion of, or in collaboration with, a foreign government or political subdivision thereof, an agent, agency or instrumentality of a foreign government or a political subdivision thereof, a political party in a foreign country or an international political organization;

(3) “Foreign agent” means any person whose actions, or any of them, are determined by or at the suggestion of, or in collaboration with, a foreign government or political subdivision thereof, an instrumentality or agency of a foreign government or political subdivision thereof, a political party in a foreign country or an international political organization;

SECTION 23-29-50 Registration by subversive and foreign-controlled organizations

Every subversive organization and organization subject to foreign control shall register with the Secretary of State on forms prescribed by him within thirty days after coming into existence in this State.

And the cherry on the icing

SECTION 23-29-60. Registration of members of subversive and foreign-controlled organizations.

Every member of a subversive organization, or an organization subject to foreign control, every foreign agent and every person who advocates, teaches, advises or practices the duty, necessity or propriety of controlling, conducting, seizing or overthrowing the government of the United States, of this State or of any political subdivision thereof by force or violence or other unlawful means, who resides, transacts any business or attempts to influence political action in this State, shall register with the Secretary of State on the forms and at the times prescribed by him.

Oh, and God forbid you fail to register before you start planning your revolution, because that’s punishable by a $25,000 fine and/ or up to ten years imprisonment.

The South Carolina blog FitsNews describes the new law as “bureaucracy for terrorists.”

SC, along with Alabama, that also requires drug dealers to declare their illegal income or face further penalties on top of the criminal penalties for buying, possessing and selling drugs.

Ingenious? Why wasn’t this included in the Patriot Act? 😉

  1. Every subversive organization so registered shall, at the time of filing, submit an accurate detailed plan describing the people, places, actions and times by which said planned subversion shall be plotted to occur, including individuals, things, or radio or other broadcast media stations to be assassinated or seized, shot, blown up or set on fire.

    Errors in such plan detail submissions, including but not limited to, spelling, punctuation or grammar shall be punishable by a $100 fine, or a year in jail, or both.

    Misspellings of the word “tyranny” shall incur double the above described penalties.

  2. Not likely that they are including their very own homegrown  secessionists/klansmen in that category, is it?  

    BTW, yesterday PBS aired an interview with a member of the new, and “improved” MI Militia–by a different name which I can’t recall.  They are organized and ready to…

    “…help in the event of ‘disasters’, and are “prepared to defend their rights”….

    Wow–and here I thought they pretty much dissipated following the horrors of Timothy McVey/ Terry Nichols.  Bet they wouldn’t have to register if they were in SC, cause, after all–they definitely aren’t a “foreign-controlled” organization.  Thankfully their successors are still alive & well & prepared to “protect” us.  The question is–from what?

    Guess it’s all in how you define “disaster”, “rights”, and “subversive”…

  3. Brings home the absurdity of the war on terra. I saw the SC governor’s ex wife on the Daily Show and when asked by Jon what she missed most about no longer being the Gov’s wife  replied that she missed the convict labor who while not allowed in the house, washed and walked her dogs, and kept the grounds in great shape. Jon Steward said ‘I’m not really comfortable with this’. This country is so different culturally and regionally that we don’t even share the same reality let alone ‘values’. Our shared history doesn’t even have the same outcome or reading. The heroes and villains are upside down depending on where you live and I don’t mean necessarily regionally.

    Let me get this right, I’m planning a federal crime ie. revolution against the government and I being the law abiding citizen I am and facing hanging for treason need to register and divulge my evil plans

  5. I can’t help wondering what the official subversion forms would look like, though.  Checklist or essay?  Multilingual, and, if so, which languages?
