Morning Migraine: BiPartisanship Commission Member Named to BiPartisanship BP Oil Spill Study
Saturday May 21, 2010 One month and one day past the destruction of the drilling rig of the Deepwater Horizon, with BP unable to stop the oil blowout destroying the Gulf, President Obama’s anonymous source announced he will appoint former Senator Bob Graham (D, FL) and former EPA head William K Reilly to a commission to study the cause of the spill, federal oversight, and the potential risks.

William K Reilly was administrator at the EPA under the first George Bush administration, George H W “Poppy” Bush, the one who invaded the Middle East the First Time and went to war against Iraq the First Time, which was called the …… Gulf War.
The commission, modeled on ones which investigated the Challenger shuttle explosion and the nuclear accident at Three Mile Island, will not include any federal officials, administration officials said this week.

Friday: Fairwell to Habeas Corpus, Greenwald on Obama’s Win on Indefinite Detention
This is a must read review in Salon of today’s court ruling on “Boumediene vs Bush” written by Glenn Greenwald, which gives the history of the creation of Bush’s prison gulag in 2006 with the Military Commissions Act, and background and then says:
If you’re secretly kidnapped by, say, a military for profit contractor and shipped off to Gitmo, the Bush DOJ contended that the detainee under Boumediene has a right to a hearing (when they get “around to it,” years later, if you survived the torture) but when you’re secretly kidnapped by Only God Knows What or Who and shipped off to Bagram’s Secret little hell holes in Afghanistan, then the non existent detainee has no rights to any such kind of hearing.
Greenwald:
In other words, the detainee’s Constitutional rights depends on where the Government decides to drop them off to be encaged. One of the first acts undertaken by the Obama DOJ that actually shocked civil libertarians was when, last February, as The New York Times put it, Obama lawyers “told a federal judge that military detainees in Afghanistan have no legal right to challenge their imprisonment there, embracing a key argument of former President Bush’s legal team.”But last April, John Bates, the Bush-43-appointed, right-wing judge overseeing the case, rejected the Bush/Obama position and held that Boumediene applies to detainees picked up outside of Afghanistan and then shipped to Bagram.
But which Bagram are they being shipped to ? The known Bagram Prison, or the one Gen McChrystal’s Secret Special Forces and the CIA and Blackwater Xe’s operations aren’t admitting the existence of ?

This is the government’s version of what’s going on with the Gulf of Mexico oil spill Saturday.
The following is a partial transcript. Everyone was speaking very quickly today, where they were repeating phrases that didn’t add much meaning, I left it out, a few phrases are transposed in order. Salazar starts out strong like somebody had a Come to Geebus talk with him, tries to sound like Winston Churchill before his Dunkirk of the Tar Balls, then reverts to mumbles. Adm. Landry is concise, and by God, if a Tarball breaches her boom deployment she’s gonna have they Navy and Coast Guard rendition that thing so fast it’s never going to know what hit it. BP’s Suttles. I think everybody would like to smack Suttles by now, but are holding back. He did acknowledge Mother Nature was cutting them a break, which was interesting.

Morning Migraine: It’s Elena Kagan for the Supremes
President Barack Obama, on a roll after his Attorney General floated the idea to the Sunday morning talkie tubes that the Miranda rule should be optional in the War on Terra, had his anonymous spokesperson let loose with the news late this evening that Elena Kagan would be his Supreme Court pick to replace retiring Justice John Paul Stevens.
Elena Kagan, a Clinton era leftover,former Dean of Harvard Law School, and current Solicitor General, would be the 3rd female on the Supreme Court at the same time, which presumably would signal the Beginning of the End Times for certain fundamentalists. Kagan has never been a judge.
Like most things in the Obama administration which start out sounding wonderful, there has to be a catch:

And Arlen Specter doesn’t like her, but remember, the Tea Party hates Arlen Specter.

It didn’t take long: in the nearly 20 years since Kagan became a law professor, she’s published very little academic scholarship- three law review articles, along with a couple of shorter essays and two brief book reviews. Somehow, Kagan got tenure at Chicago in 1995 on the basis of a single article in The Supreme Court Review-a scholarly journal edited by Chicago’s own faculty-and a short essay in the school’s law review.

But on the vast majority of issues before the Court, Kagan has no stated opinion. Her scholarship provides no clues regarding how she would rule on such crucial contemporary issues as the scope of the president’s power in wartime, the legality of torture, or the ability of Congress to rein in campaign spending by corporations.

Senator Sherrod Brown’s (D OH) amendment 3733 on the Financial Stability Act bill, to break up the Big 6 Banks into smaller ones that couldn’t take down the entire nation’s economy if they failed, itself did not pass the vote in the Senate this evening, failing by a spectacular 61 noes to 33 yeas, with 6 senators too timid to approach the subject.

Cimate: Today’s Gulf Images, Govt Denies Spread Potential of 19 mil oil gallons to Florida
Today is Tuesday, May the 4th, the 2 week anniversary of the blowout, fire, and sinking of the BP Deepwater Horizon oil drilling rig in the Gulf of Mexico. 14 days x 5000 barrels per day, = 70,000 barrels, or 2,940,000 gallons of oil so far have been dumped into the Gulf. Climate: This Oil Spill is Bigger Than Delaware, You Idiots!
The BP Deepwater Horizon drilling rig failed on Tuesday evening April 20, 2010, 14 days ago.
This is what it looked like Saturday, May 1st. I took a satellite picture from the NRL Monterey of the Gulf of Mexico that was showing biological substances, cropped it, and color enhanced it by playing with the settings on iphoto, to make the colors have more contrast. Since oil is based on organics, this made it show up better, and I could recreate, roughly, what the LSU ESL was doing to get the oil to show up on their pictures I posted previously. Because there were thunderstorms this past weekend, the area was obscured by cloud cover often. I also noticed the government was not putting up daily picture updates.

The heavier part of the slick is gray, the lighter part of the slick is very hard to see, but is there and greenish grey. The coast outline is drawn in pink by the website. The ^ triangle to the north in the shoreline is the Bay of Mobile, Alabama. To find the origin of the slick, look down from the left side of that triangle of the Mobile Bay and come out from the Delta about at a 45ยบ degree angle, where the lines would meet, is roughly where the broken drill rig is. Where the up and down brilliant blue longitude line is to the right touches shore, is where Pensicola Bay is in the Florida panhandle.

As you can see from this larger view, the slick actually has spread quite a bit towards the Florida Panhandle by Saturday the 1st.

Sunday May 2- This lovely overlay picture below is the satellite of the eastern half of the US, including the gulf of Mexico, with the wind direction and speed marked on it. Think of the little color icons as brooms with the stick end pointing towards what way the wind is going, and the bigger the broom, the faster. There were several thunderstorm fronts moving thru to the southeast, and the wind in the Gulf is spinning in a clockwise manner, driving the waves and the oil around and around and easterly at the same time.

The other thing you can see here is a big low pressure system spinning off the eastern coast and it’s spinning counterclockwise. Look at Florida. Now look at Cuba, the long island under it, then to its right, the island with Haiti and the Dominican Republic, and to the right of that, little bitty Puerto Rico, the rectangle island.
Do you see how small Puerto Rico is ? Do you see how big the oil slick is, in the first picture ? Do you know how stupid White House Correspondent Cokie Roberts looked, prattling about how the oil slick is so big it was as big as Puerto Rico, all day Saturday, when she wasn’t blathering about the White House Correspondent’s dinner ?
