On this day in 1813, former President Thomas Jefferson writes former President John Adams to let him know that their mutual friend, Dr. Benjamin Rush, has died.

Rush’s passing caused Jefferson to meditate upon the departure of the Revolutionary generation. He wrote, We too must go; and that ere long. I believe we are under half a dozen at present; I mean the signers of the Declaration.

A Rift

Despite their close friendship, Jefferson wrote that he and Adams were often separated by “different conclusions we had drawn from our political reading.” The two maintained their friendship despite their political differences until 1801, the year that Jefferson became president. As Jefferson wrote Mrs. Adams: “I can say with truth that one act of Mr. Adams’s life, and one only, ever gave me a moment’s personal displeasure.” By this, Jefferson was referring to last-minute political appointments made by Adams just before Jefferson succeeded him as president. Jefferson wrote that the appointments “were [selected] from among my most ardent political enemies” who could be counted on to work against his executive authority. Jefferson admitted to “brooding over it for some little time,” and during this period, they ceased writing one another.

A Reconciliation

When Jefferson retired from the presidency in 1809, Dr. Benjamin Rush, a signer of the Declaration that Adams and Jefferson worked to create, took it upon himself to renew their suspended friendship. He had no success until 1811, when one of Jefferson’s neighbors visited Adams in Massachusetts. The neighbor returned to Virginia with the report that he had heard Adams say, “I always loved Jefferson, and still love him.” In response to these words, Jefferson wrote Dr. Rush: “This is enough for me. I only needed this knowledge to revive towards him all of the affections of the most cordial moments of our lives.” He asked Rush to persuade Adams to renew their correspondence. A letter from Adams was forthcoming, and they continued to write until their deaths.

This reconciliation began a rich correspondence that touched on myriad topics, from reminiscences about their contributions to the young nation’s history, to opinions on current political issues, to matters of philosophy and religion, to issues of aging. Their letters were also lighthearted and filled with affection. Jefferson wrote, “I have compared notes with Mr. Adams on the score of progeny, and find I am ahead of him, and think I am in a fair way to keep so. I have 10 1/2 grandchildren, and 2 3/4 great-grand-children; and these fractions will ere long become units.”

A Lasting Legacy

After fifteen years of resumed friendship, on July 4, 1826, Jefferson and Adams died within hours of each other. Their deaths occurred — perhaps appropriately — on the fiftieth anniversary of the signing of the Declaration of Independence. Unaware that his friend had died hours earlier, Adams’ last spoken words were “Jefferson still survives.”

On this day in 1637, an allied Puritan and Mohegan force under English Captain John Mason attacks a Pequot village in Connecticut, burning or massacring some 500 Indian women, men, and children.

The Pequot War was an armed conflict in 1634-1638 between the Pequot tribe against an alliance of the Massachusetts Bay, Plymouth, and Saybrook colonies with American Indian allies (the Narragansett and Mohegan tribes). Hundreds were killed; hundreds more were captured and sold into slavery to the West Indies. Other survivors were dispersed. At the end of the war, about seven hundred Pequots had been killed or taken into captivity. The result was the elimination of the Pequot as a viable polity in what is present-day Southern New England. It would take the Pequot more than three and a half centuries to regain political and economic power in their traditional homeland region along the Pequot (present-day Thames) and Mystic rivers in what is now southeastern Connecticut.

The Mystic massacre

Believing that the English had returned to Boston, the Pequot sachem Sassacus took several hundred of his warriors to make another raid on Hartford. Mason had visited and recruited the Narragansett, who joined him with several hundred warriors. Several allied Niantic warriors also joined Mason’s group. On May 26, 1637, with a force up to about 400 fighting men, Mason attacked Misistuck by surprise. He estimated that “six or seven Hundred” Pequot were there when his forces assaulted the palisade. As some 150 warriors had accompanied Sassacus to Hartford, so the inhabitants remaining were largely Pequot women and children, and older men. Mason ordered that the enclosure be set on fire. Justifying his conduct later, Mason declared that the attack against the Pequot was the act of a God who “laughed his Enemies and the Enemies of his People to scorn making [the Pequot] as a fiery Oven . . . Thus did the Lord judge among the Heathen, filling [Mystic] with dead Bodies.”  Mason insisted that any Pequot attempting to escape the flames should be killed. Of the estimated 600 to 700 Pequot resident at Mystic that day, only seven survived to be taken prisoner, while another seven escaped to the woods.

The Narragansett and Mohegan warriors with Mason and Underhill’s colonial militia were horrified by the actions and “manner of the Englishmen’s fight . . . because it is too furious, and slays too many men.” The Narragansett left the warfare and returned home.

Believing the mission accomplished, Mason set out for home. Becoming temporarily lost, his militia narrowly missed returning Pequot warriors. After seeing the destruction of Mystic, they gave chase to the English forces, but to little avail.

Rail Transport of Oil Safe. So Says the Oil Industry

With the debate over the Keystone XL Pipeline continuing, another important issue has arisen, transportation of crude oil by rail. Recent derailments and explosions have also brought into question safety considerations and the transport of Bakken crude, which is more dangerous to ship than other crude oil due to its flammability. This is not a new problem, in fact, it has been going on for decades and has been focused on the railroad tank car used, the DOT-111-A, as this McClathcy article reported in January:

Federal regulators might be weeks away from issuing new safety guidelines for tank cars carrying flammable liquids, after a series of frightening rail accidents over the past six months.

But the type of general-service tank car involved in recent incidents with crude oil trains in Quebec, Alabama and North Dakota – the DOT-111-A – has a poor safety record with hazardous cargoes that goes back decades, raising questions about why it took so long for the railroad industry and its federal regulators to address a problem they knew how to fix.

Other, more specialized types of tank cars received safety upgrades in the 1980s, and the industry’s own research shows they were effective at reducing the severity of accidents.

Tank car manufacturers have built new DOT-111A cars to a higher standard since 2011, but the improvements haven’t caught up to tens of thousands of older cars.

To be sure, improper railroad operations or defective track cause many accidents involving tank cars. But the National Transportation Safety Board, which makes recommendations but has no regulatory authority, has cited the DOT-111A’s deficiencies many times over the years for making accidents worse than they could have been.

In a segment on her show just last week, MSNBC’s Rachel Maddow illustrated the safety shortcomings of those rail tank cars used to transport this volatile crude oil, pointing to accidents, explosions, and toothless warnings going back over decades.

In April, the National Transportation and Safety Board (NTSB) has called on regulators to tighten standards and in early May, the Transportation Department issued a safety advisory pleading with companies that transport crude oil by train to discontinue old railcars

The advisory is non-binding, meaning it does not require companies to follow it, as an emergency order would. Yet it does apply to approximately 20,000 old tanker cars that companies rely on to carry Bakken crude from oil fields in North Dakota throughout the continent. The Transportation Department (DOT) recommended that only the sturdiest cars available are put to use, and that cars that cannot be destroyed should be updated.

Wednesday’s advisory came on the same day that the Transportation Department issued an emergency order forcing companies to provide communities alongside the rail routes with more information about the problems that are created when a spill or explosion takes place.  [..]

The DOT itself admitted crude shipments present “an imminent hazard” in an emergency order forcing companies to be more transparent with the areas they go through. Trains carrying oil generally include at least 100 cars. The emergency order requires all carloads with more than one million gallons of Bakken crude, equivalent to approximately 35 cars, to give local lawmakers notice that a train will be making its way through. [..]

Companies shipping oil by rail have never been forced to notify communities regarding hazardous material on board until this week.

An estimated 715,000 barrels of Bakken crude oil are shipped by rail every day.

It appears the oil industry is not going to lie down and take it.

American Petroleum Institute said it’s important to “separate fact from fiction” when it comes to shipping crude oil from North Dakota by rail.

The North Dakota Petroleum Council published a study Tuesday that shows crude oil taken from the Bakken reserve area in the state is similar to other grades of oil from North America. It does not, as the U.S. Department of Transportation suggests, pose a greater risk when transported by rail, the council said.

It is past time that the Department of Transportation stopped issuing toothless warnings and cracked down with inspections and heavy fines.

Just so you know, I usually spend hours working on my breakfast club posts, but I’m having a brunch tomorrow and will be entertaining my boyfriend from high school (a cool rock musician) and his wife (a cool doctor), and a new friend I met on a temp job and her fiancee, who are moving to the Midwest in a few days. I want to get back into the kitchen!  We are having a quinoa salpicon, green tea noodle salad, oeuf cocottes with salmon and dill, mini quiches, charcuterie and cheese, nuts, olives, bread, fruit and coconut jello with fruit!  Plus I am going to juice some oranges and add prosecco to that for yummy brunch drinks.  So, forgive me if it seems like I’m rushing through this post because, in fact, I am.

On this day in 1977, Stars Wars opens with an intergalactic bang as the first of George Lucas’ blockbuster Star Wars movies hits American theaters.

Star Wars Episode IV: A New Hope, originally released as Star Wars, is a 1977 American epic space opera film, written and directed by George Lucas. It is the first of six films released in the Star Wars saga: two subsequent films complete the original trilogy, while a prequel trilogy completes the six-film saga. It is the fourth film in terms of the series’ internal chronology. Ground-breaking in its use of special effects, unconventional editing, and science fiction/fantasy storytelling, the original Star Wars is one of the most successful and influential films of all time.

Set “a long time ago in a galaxy far, far away”, the film follows a group of freedom fighters known as the Rebel Alliance as they plot to destroy the powerful Death Star space station, a devastating weapon created by the evil Galactic Empire. This conflict disrupts the isolated life of farmboy Luke Skywalker when he inadvertently acquires the droids carrying the stolen plans to the Death Star. After the Empire begins a cruel and destructive search for the droids, Skywalker decides to accompany Jedi Knight Obi-Wan Kenobi on a daring mission to rescue the owner of the droids, rebel leader Princess Leia Organa, and save the galaxy.

Produced with a budget of $11 million and released on May 25, 1977, the film went on to earn $460 million in the United States and $337 million overseas, surpassing Jaws as the highest-grossing film of all time at the time. Among the many awards the film received, it gained ten Academy Award nominations, winning six; the nominations included Best Supporting Actor for Alec Guinness and Best Picture. Lucas has re-released the film on several occasions, sometimes with significant changes; the most notable versions are the 1997 Special Edition and the 2004 DVD release, which have modified computer-generated effects, altered dialogue, and added scenes.

On this day in 1775, John Hancock is elected president of the Second Continental Congress.

ohn Hancock is best known for his large signature on the Declaration of Independence, which he jested the British could read without spectacles. He was serving as president of Congress upon the declaration’s adoption on July 4, 1776, and, as such, was the first member of the Congress to sign the historic document.

John Hancock graduated from Harvard University in 1754 at age 17 and, with the help of a large inherited fortune, established himself as Boston’s leading merchant. The British customs raid on one of Hancock’s ships, the sloop Liberty, in 1768 incited riots so severe that the British army fled the city of Boston to its barracks in Boston Harbor. Boston merchants promptly agreed to a non-importation agreement to protest the British action. Two years later, it was a scuffle between Patriot protestors and British soldiers on Hancock’s wharf that set the stage for the Boston Massacre.

Hancock’s involvement with Samuel Adams and his radical group, the Sons of Liberty, won the wealthy merchant the dubious distinction of being one of only two Patriots-the other being Sam Adams-that the Redcoats marching to Lexington in April 1775 to confiscate Patriot arms were ordered to arrest. When British General Thomas Gage offered amnesty to the colonists holding Boston under siege, he excluded the same two men from his offer.

President of Congress

With the war underway, Hancock made his way to the Continental Congress in Philadelphia with the other Massachusetts delegates. On May 24, 1775, he was unanimously elected President of the Continental Congress, succeeding Peyton Randolph after Henry Middleton declined the nomination. Hancock was a good choice for president for several reasons. He was experienced, having often presided over legislative bodies and town meetings in Massachusetts. His wealth and social standing inspired the confidence of moderate delegates, while his association with Boston radicals made him acceptable to other radicals. His position was somewhat ambiguous, because the role of the president was not fully defined, and it was not clear if Randolph had resigned or was on a leave of absence. Like other presidents of Congress, Hancock’s authority was limited to that of a presiding officer. He also had to handle a great deal of official correspondence, and he found it necessary to hire clerks at his own expense to help with the paperwork.

Signing the Declaration

Hancock was president of Congress when the Declaration of Independence was adopted and signed. He is primarily remembered by Americans for his large, flamboyant signature on the Declaration, so much so that “John Hancock” became, in the United States, an informal synonym for signature. According to legend, Hancock signed his name largely and clearly so that King George could read it without his spectacles, but this fanciful story did not appear until many years later.

On this day in 1873, the Canadian Parliament establishes the North West Mounted Police, the forerunner of the Royal Canadian Mounted Police.

North-West Mounted Police

The RCMP has its beginnings in the North-West Mounted Police (NWMP). The police was established by an act of legislation from the Temporary North-West Council the first territorial government of the Northwest Territories. The Act was approved by the Government of Canada and established on May 23, 1873, by Queen Victoria, on the advice of her Canadian Prime Minister, John A. Macdonald, with the intent of bringing law and order to, and asserting sovereignty over, the Northwest Territories. The need was particularly urgent given reports of American whiskey traders, in particular those of Fort Whoop-Up, causing trouble in the region, culminating in the Cypress Hills Massacre. The new force was initially to be called the North West Mounted Rifles, but this proposal was rejected as sounding too militaristic in nature, which Macdonald feared would antagonize both aboriginals and Americans; however, the force was organized along the lines of a cavalry regiment in the British Army, and was to wear red uniforms.

The NWMP was modelled directly on the Royal Irish Constabulary, a civilian paramilitary armed police force with both mounted and foot elements under the authority of what was then the United Kingdom of Great Britain and Ireland. First NWMP commissioner, Colonel George Arthur French visited Ireland to learn its methods.

The initial force, commanded by Commissioner French, was assembled at Fort Dufferin, Manitoba. They departed on July 8, 1874, on a march to what is now Alberta.

The group comprised 22 officers, 287 men – called constables and sub-constables – 310 horses, 67 wagons, 114 ox-carts, 18 yoke of oxen, 50 cows and 40 calves. A pictorial account of the journey was recorded in the diary of Henri Julien, an artist from the Canadian Illustrated News, who accompanied the expedition.

Their destination was Fort Whoop-Up, a notorious whiskey trading post located at the junction of the Belly and Oldman Rivers. Upon arrival at Whoop-Up and finding it abandoned the troop continued a few miles west and established headquarters on an island in the Oldman, naming it Fort MacLeod.

Historians have theorized that failure of the 1874 March West would not have completely ended the Canadian federal government’s vision of settling the country’s western plains, but could have delayed it for many years. It could also have encouraged the Canadian Pacific Railway to seek a more northerly route for its transcontinental railway that went through the well-mapped and partially settled valley of the North Saskatchewan River, touching on Prince Albert, Battleford and Edmonton, and through the Yellowhead Pass, as originally proposed by Sandford Fleming. This would have offered no economic justification for the existence of cities like Brandon, Regina, Moose Jaw, Swift Current, Medicine Hat, and Calgary, which could, in turn, have tempted American expansionists to make a play for the flat, empty southern regions of the Canadian prairies.

The NWMP’s early activities included containing the whiskey trade and enforcing agreements with the First Nations peoples; to that end, the commanding officer of the force arranged to be sworn in as a justice of the peace, which allowed for magisterial authority within the Mounties’ jurisdiction. In the early years, the force’s dedication to enforcing the law on behalf of the First Nations peoples impressed the latter enough to encourage good relations between them and the Crown. In the summer of 1876, Sitting Bull and thousands of Sioux fled from the US Army towards what is now southern Saskatchewan, and James Morrow Walsh of the NWMP was charged with maintaining control in the large Sioux settlement at Wood Mountain. Walsh and Sitting Bull became good friends, and the peace at Wood Mountain was maintained. In 1885, the NWMP helped to quell the North-West Rebellion led by Louis Riel. They suffered particularly heavy losses during the Battle of Duck Lake, but saw little other active combat.

On this day in 1843, the Great Emigration departs for Oregon

A massive wagon train, made up of 1,000 settlers and 1,000 head of cattle, sets off down the Oregon Trail from Independence, Missouri. Known as the “Great Emigration,” the expedition came two years after the first modest party of settlers made the long, overland journey to Oregon.

Great Migration of 1843

In what was dubbed “The Great Migration of 1843” or the “Wagon Train of 1843”, an estimated 700 to 1,000 emigrants left for Oregon. They were led initially by John Gantt, a former U.S. Army Captain and fur trader who was contracted to guide the train to Fort Hall for $1 per person. The winter before, Marcus Whitman had made a brutal mid-winter trip from Oregon to St. Louis to appeal a decision by his Mission backers to abandon several of the Oregon missions. He joined the wagon train at the Platte River for the return trip. When the pioneers were told at Fort Hall by agents from the Hudson’s Bay Company that they should abandon their wagons there and use pack animals the rest of the way, Whitman disagreed and volunteered to lead the wagons to Oregon. He believed the wagon trains were large enough that they could build whatever road improvements they needed to make the trip with their wagons. The biggest obstacle they faced was in the Blue Mountains of Oregon where they had to cut and clear a trail through heavy timber. The wagons were stopped at The Dalles, Oregon by the lack of a road around Mount Hood. The wagons had to be disassembled and floated down the treacherous Columbia River and the animals herded over the rough Lolo trail to get by Mt. Hood. Nearly all of the settlers in the 1843 wagon trains arrived in the Willamette Valley by early October. A passable wagon trail now existed from the Missouri River to The Dalles. In 1846, the Barlow Road was completed around Mount Hood, providing a rough but completely passable wagon trail from the Missouri river to the Willamette Valley-about 2,000 miles.

PE Slump

Private-equity transactions overall have fallen 22 percent to $53 billion through April, data compiled by Bloomberg show, led by the drop in buyouts of public companies. The value of those leveraged buyouts declined to $3.2 billion compared with an average of $34 billion in the 10 years through 2013.

The peak for buyouts came before the financial crisis, when U.S. funds struck $659 billion of deals from 2005 through 2007, including the purchases of HCA Inc., Hilton Worldwide Inc. and Biomet Inc., the data show. Buying inexpensive public companies was generally easier for the funds than carve-outs are, said Raymond Lin, a mergers and acquisitions attorney at Latham & Watkins LLP.

“The easy days for private-equity buyers are over when they profited from buying undervalued companies,” he said. “Carve-out deals require a lot of up-front work that would incur additional costs and could affect returns.”

The Standard & Poor’s 500 Index, which reached a record this week, trades at 17.4 times reported profit, the highest level since 2010, according to data compiled by Bloomberg.

PE’s Limits

While high valuations haven’t scared off dealmaking between companies, buyout firms are motivated by different factors, said Gordon Caplan, chairman of the private-equity practice group at law firm Willkie Farr & Gallagher LLP.

“If business growth slows, companies have to buy things,” he said. “Private-equity buyers can’t create synergies like company mergers can in most cases.”

Corporations are more willing to spin off divisions as management continues to clean up underperforming businesses and pay down debt following the financial crisis, said Tom Franco, a partner at Clayton Dubilier.

SEC Official Describes Widespread Lawbreaking and Material Weakness in Controls in Private Equity Industry

At a private equity conference this week, Drew Bowden, a senior SEC official, told private equity fund managers and their investors in considerable detail about how the agency had found widespread stealing and other serious infractions in its audits of private equity firms.

In the years that I’ve been reading speeches from regulators, I’ve never seen anything remotely like Bowden’s talk. I’ve embedded it at the end of this post and strongly encourage you to read it in full.

Despite the at times disconcertingly polite tone, the SEC has now announced that more than 50 percent of private equity firms it has audited have engaged in serious infractions of securities laws. These abuses were detected thanks to to Dodd Frank. Private equity general partners had been unregulated until early 2012, when they were required to SEC regulation as investment advisers. [..]

Bowden pointed out that private equity is unique among the investment advisers the SEC supervises. The general partners’ control of portfolio companies gives them access to their cash flows, which the GPs can divert into their own pockets in numerous ways. Naked Capitalism readers may recognize that this arrangement is similar to the position mortgage servicers are in: they control the relationship with the funds source, and they are also responsible for records-keeping and remitting money to investors. And as we’ve chronicled at considerable length, servicers have shown remarkable creativity in lining their wallets and investors have been unable to discipline them. [..]

Needless to say, this overly cozy arrangement has proven to be a ripe breeding ground for illegal conduct.

On this day in 1881, the American Red Cross was established in Washington, D.C. by Clara Barton, who became the first president of the organization.

Clara Barton

Clara Barton (1821-1912) had a career as a teacher and federal bureaucrat when the American Civil War broke out. Barton liked teaching when she was younger. All of her older siblings became teachers. Her youngest sibling was 12 years of age, when Barton was born. Her brother David was always like a teacher to her. She taught her first class, at age 17. She also expanded her concept of soldier aid, traveling to Camp Parole, Maryland, to organize a program for locating men listed as missing in action. Through interviews with Federals returning from Southern prisons, she was often able to determine the status of some of the missing and notify families.

After performing humanitarian work during and after the conflict, on advice of her doctors, in 1869, she went to Europe for a restful vacation. There, she saw and became involved in the work of the International Red Cross during the Franco-Prussian War, and determined to bring the organization home with her to America.

When Barton began the organizing work in the U.S. in 1873, no one thought the country would ever again face an experience like the Civil War. However, Barton was not one to lose hope in the face of the bureaucracy, and she finally succeeded during the administration of President Chester A. Arthur on the basis that the new American Red Cross organization could also be available to respond to other types of crisis.

As Barton expanded the original concept of the Red Cross to include assisting in any great national disaster, this service brought the United States the “Good Samaritan of Nations” label in the International Red Cross. Barton became President of the American branch of the society, known officially as the American National Red Cross. Soon after the initial May 1881 meeting in Washington, on August 22, 1881, the first local chapter of the Red Cross was formed in village of Dansville, New York, where Barton kept a part-time residence between 1876 and 1886. Subsequent local chapters were established in Rochester and Syracuse. Ultimately, John D. Rockefeller, along with four others and the federal government, gave money to create a national headquarters in Washington, D.C., located one block from the White House.

May 20 is the 140th day of the year (141st in leap years) in the Gregorian calendar. There are 225 days remaining until the end of the year.

On this day on 1896, the six ton chandelier of the Palais Garnier falls on the crowd resulting in the death of one and the injury of many others. The falling of one of the counterweights for the grand chandelier resulted in the death of one person.

This incident, as well as the underground lake, cellars, along with the other elements of the Opera House even the building itself were the inspirations of Gaston Leroux for his classic 1910 Gothic novel, The Phantom of the Opera.

The ceiling area, which surrounds the chandelier, was given a new painting during 1964 by Marc Chagall. This painting was controversial, with many people feeling Chagall’s work clashed with the style of the rest of the theater.

The Palais Garnier, known also as the Opéra de Paris or Opéra Garnier, but more commonly as the Paris Opéra, is a 1,600-seat opera house on the Place de l’Opéra in Paris, France, which was the primary home of the Paris Opera from 1875 until 1989. A grand building designed by Charles Garnier in the Neo-Baroque (or “Baroque Revival”) style (it is also said to be of the related Second Empire style), it is regarded as one of the architectural masterpieces of its time.

Upon its inauguration during 1875, the opera house was named officially the Académie Nationale de Musique – Théâtre de l’Opéra. It retained this title until 1978 when it was re-named the Théâtre National de l’Opéra de Paris. After the opera company chose the Opéra Bastille as their principal theatre upon its completion during 1989, the theatre was re-named as the Palais Garnier, though Académie Nationale de Musique is still sprawled above the columns of its front façade. In spite of the change of names and the Opera company’s relocation to the Opéra Bastille, the Palais Garnier is still known by many people as the Paris Opéra, as have all of the several theatres which have served as the principal venues of the Parisian Opera and Ballet since its initiation.

History

The Palais Garnier was designed as part of the great reconstruction of Paris during the Second Empire initiated by Emperor Napoleon III, who chose Baron Haussmann to supervise the reconstruction. During 1858 the Emperor authorized Haussmann to clear the required 12,000 square metres (1.2 ha) of land on which to build a second theatre for the world-renowned Parisian Opera and Ballet companies. The project was the subject of architectural design competition during 1861, and was won by the architect Charles Garnier (1825-1898). The foundation stone was laid during 1861, with the start of construction during 1862. Legend is that the Emperor’s wife, the Empress Eugénie, asked Garnier during the construction whether the building would be built in the Greek or Roman style, to which he replied: “It is in the Napoleon III style, Madame!”
