Prop 19: AG Holder Issues Shocking Threat Against State’s Rights To Legalize MJ

( If you needed proof that the current “Democratic” administration is throwing support behind getting more Republicans elected this November instead of Democrats, here’s more.)

The Obama administration’s Attorney General Eric Holder, fresh off his decision to appeal of Judge Virginia Phillip’s injunction against enforcing DADT because of its unConstitutionality, has written a shocking letter to the former chiefs of the DEA on Oct 13th.   And why did he write them a letter ?  Because they want the Attorney General to sue California if Proposition 19 passes, which would decriminalize marijuana at the state level.  

Holder just sent them a letter in agreement.  


“We will vigorously enforce the CSA (Controlled Substances Act) against those individuals and organizations that possess, manufacture or distribute marijuana for recreational use, even if such activities are permitted under state law,” Holder wrote.

The Department of Justice under Holder has not decreased the number of arrests and prosecutions for marijuana possession compared to the previous Bush administration, in spite of  assurances that medical marijuana users in the state of California would not be targeted. https://www.docudharma.com/diar…  Over a quarter million Californians were arrested last year for drug offenses, with 52% of them being for pot, that’s over 115,000 people getting arrested in CA in 2008 just for possession, per statistics from the FBI.  Make no mistake about it, this is a big cash incentive the Feds are waving at the state when they declare your local LE can only get money this way.

Los Angeles County Sheriff Lee Baca, co chair of the “Public Safety No On 19” committee along with Democratic Sen. Dianne Feinstein,  also said at a news conference that Federal law would over rule state law and therefore any new law would be unenforceable, and that public use of the drug would continue to be targeted, as usual,  whether or not Prop 19 passes.

The “Yes on 19” committee’s former San Jose Police Chief Joseph McNamara issued a response today, saying that:


“Passing Proposition 19 in California will undoubtedly kick start a national conversation about changing our country’s obviously failed marijuana prohibition policies,” he added. “If the federal government wants to keep fighting the nation’s failed ‘war on marijuana’  while we’re in the midst of a sagging economic recovery and two wars, it just proves that the establishment politicians’ priorities are wrongly focused on maintaining the status quo.”

McNamara, now a research fellow in drug policy at Stanford University, has argued that the 60 percent of the cash that supports violent drug cartels comes from the sale of illegal marijuana.

Is that a sign of intelligent design in this hideous panorama of Los Angeles?

“Architecture is rediscovering its social conscience,” says the New York Times. “That’s the message behind “Small Scale, Big Change: New Architectures of Social Engagement,” an exhibition at the Museum of Modern Art.”

The show, which looks at 11 projects around the world that have had major social impacts despite modest budgets and sizes, is a rebuttal to the familiar complaint that the profession is too focused on aesthetic experimentation and not enough on the lives of ordinary people.

Brilliant! Apparently the profession of architecture just noticed that downtown Los Angeles is a desert after 6PM, and except for the Hills above Hollywood and Sunset Boulevard, the rest of it isn’t much more than a wasteland of slums and suburbs.

But what about all that “aesthetic experimentation?” Doesn’t it possess some redeeming value apart from whatever afterthought of a species may run in and out of it?  

DADT: Judge Phillips issues her injunction

Judge Virginia A Phillips, US District Court, Central District of CA,  has issued an injunction which halts enforcement of the Pentagon’s discriminatory “Don’t Ask, Don’t Tell” policy, after ruling it unconstitutional last month on Sept 9, .

A writeup yesterday from Law.com thinks that the Obama administration will continue to defend DADT, instead of letting the policy just die,  while waiting for  Congress to further write a new law, Sec of Defense Gates to complete his “study and survey,” and the Supreme Court to eventually issue their opinion on the appeal.

Senators Gillibrand and Udall have sent a public letter urging Attorney General Eric Holder not to appeal, saying such could hold back Congress further.

Still, several signs indicate that the Obama administration plans to continue to defend Don’t Ask, Don’t Tell. When asked about the government’s next move, Justice Department spokeswoman Tracy Schmaler said in an e-mailed statement to The National Law Journal: “The Justice Department is defending the statute, as it traditionally does when acts of Congress are challenged.”

The Justice Department already has filed an opposition to a proposed permanent injunction that would bar enforcement of Don’t Ask, Don’t Tell worldwide. In it, the government said that an injunction, if granted, should be limited to members of the Log Cabin Republicans.

If Phillips grants the injunction, the government could ask the 9th Circuit for a stay pending any appeal and for a stay to be granted, said Adam Winkler, a constitutional law professor at the University of California at Los Angeles School of Law. “If she enters a permanent injunction without a stay of appeal, it will seem like a power grab,” he said of Phillips. “The 9th Circuit won’t look kindly upon it.”

As I pointed out previously, the Log Cabin Republicans are Republicans, and to limit the stay of this discriminatory law to their group, says that the US Constitution is not political party neutral,  and the Obama Administration thinks only Republicans are qualified to deserve civil rights and equal protection under the law. Another lawyer in the article pointed out there is a tendency for the judiciary to “defer” to the military.  The last time I looked, there is absolutely nothing in the Constitution which stated that military service can only be performed by members of one specific political party.   The Commander in Chief is still an elected civilian position, no party specified, at least in stated law.  Membership qualifications in a political party to obtain full benefit of the law, even military law, reeks of codified bribery.

The solution is obvious, the Attorney General of the U.S. should not appeal this ruling, to do otherwise implies Justice is for Sale, and our military forces are open to the highest bidder vying for the attention of one of 100 Senators.  This becomes an issue of national sovereignty.  Let DADT die.  Its time has passed.

Obama Undone By His Own Bullshit

Republicans and tea-baggers are winning the public debate about “big government” with the argument that “big spending” has failed to reduce unemployment much below 10%, and why are Obama and the Democrats so pitifully ineffective at refuting the dim-witted rants of a mob of yahoos?

Paul Krugman analyzed Obama’s self-inflicted dilemma in a recent column.

Actually, the administration has had a messaging problem on economic policy ever since its first months in office, when it went for a stimulus plan that many of us warned from the beginning was inadequate given the size of the economy’s troubles.

You can argue that Mr. Obama got all he could – that a larger plan wouldn’t have made it through Congress (which is questionable), and that an inadequate stimulus was much better than none at all (which it was). But that’s not an argument the administration ever made. Instead, it has insisted throughout that its original plan was just right, a position that has become increasingly awkward as the recovery stalls.

And a side consequence of this awkward positioning is that officials can’t easily offer the obvious rebuttal  to claims that big spending failed to fix the economy – namely, that thanks to the inadequate scale of the Recovery Act, big spending never happened in the first place.

The real story is clear enough in the graphic below, from the Bureau of Labor Statistics, representing the total number of jobs in the USA month by month, in thousands.

The bottom falls out of employment beginning in August 2008, high-lighted in red, 460,000 jobs disappear between August and September, and  month after month 550,000 jobs vanish between September and October, then 720,000, then 670,000, and so on until November and December 2009, when the bleeding finally stops, and very modest growth ensues.

This is the story Democrats should have been telling over and over and over and over, on every talk-show and at every press conference. Bush/Cheney cut the throat of the American economy, Obama’s stimulus stopped the bleeding, and now we need another transfusion.

But Obama pretended that his original stimulus was just exactly right, and now Democrats don’t have a story to tell.

…the Supreme Court said it would not take up a warrantless surveillance case, Wilner v. National Security Agency (NSA), filed by the Center for Constitutional Rights (CCR). The lawsuit argued that the Executive Branch must disclose whether or not it has records related to the wiretapping of privileged attorney-client conversations without a warrant. Lawyers for the Guantánamo detainees fit the officially acknowledged profile of those subject to surveillance under the former administration’s program, and the Bush administration argued in the past that the Executive Branch has a right to target them.

The Obama administration has never taken a position-in this or any of the other related cases-on whether the Bush administration’s NSA surveillance program was legal. In this case they claimed that even if it was illegal, the government has the right to remain silent when asked whether or not the NSA spied on lawyers,” said Shayana Kadidal, Senior Managing Attorney of the CCR Guantánamo Global Justice Initiative. “Today the Supreme Court let them get away with it.”  […]

The plaintiffs [had] filed a Freedom of Information Act (FOIA) request seeking records of any surveillance of their communications under the NSA’s warrantless surveillance program, which began after 9/11 but was only disclosed to the public in December 2005. The government refused to either confirm or deny whether such records existed, and the lower courts refused to order the government to confirm whether it had eavesdropped on attorney-client communications. The question before the Supreme Court was whether the government can refuse to confirm or deny whether records of such surveillance exist, even though any such surveillance would necessarily be unconstitutional and illegal.

In my past diaries on Yes on Proposition 19,    Control and Tax Cannabis, aka marijuana decriminalization in California, I’ve shown that right wing conservatives funded by their usual business interests, are behind the continued attempt to let the Federal government waste money on continued harassment of pot users.  I agree with the former San Jose Police Chief Joseph McNamara, who says that:


most bad things about marijuana – especially the violence made inevitable by an obscenely profitable black market – are caused by the prohibition, not by the plant.

An “obscenely profitable”  black market cannot exist with out high level cynicism and corruption in our Federal, state, and even sometimes, county governments.  The state of CA has been severely cutting back maintenance, employees, hours, access to public parks and recreational areas and facilities for outdoor sports and recreational users under their self inflicted “budget austerity,” and the Federal government has been socking us with increased, draconian “user fees,” for groups,  yet they continue to have plenty of loot to fight against personal growing of a weedy herb, which would deflate the market for it.  Priorities are misplaced.  The war on pot has been an expensive failure.

The War Addicts – 2016 and Then Some

Sometimes it’s the little things in the big stories that catch your eye.  On Monday, the Washington Post ran the first of three pieces adapted from Bob Woodward’s new book Obama’s Wars, a vivid account of the way the U.S. high command boxed the Commander-in-Chief into the smallest of Afghan corners.  As an illustration, the Post included a graphic the military offered President Obama at a key November 2009 meeting to review war policy.  It caught in a nutshell the favored “solution” to the Afghan War of those in charge of fighting it — Admiral Mike Mullen, Chairman of the Joint Chiefs of Staff, General David Petraeus, then-Centcom commander, General Stanley McChrystal, then-Afghan War commander, and Secretary of Defense Robert Gates, among others.

Labeled “Alternative Mission in Afghanistan,” it’s a classic of visual wish fulfillment.  Atop it is a soaring green line that represents the growing strength of the notoriously underwhelming “Afghan Forces,” military and police, as they move toward a theoretical goal of 400,000 — an unlikely “end state” given present desertion rates.  Underneath that green trajectory of putative success is a modest, herky-jerky blue curving line, representing the 40,000 U.S. troops Gates, Petraeus, Mullen, and company were pressuring the president to surge into Afghanistan.

The eye-catching detail, however, was the dating on the chart.  Sometime between 2013 and 2016, according to a hesitant dotted white line (that left plenty of room for error), those U.S. surge forces would be drawn down radically enough to dip somewhere below — don’t gasp — the 68,000 level.  In other words, three to six years from now, if all went as planned — a radical unlikelihood, given the Afghan War so far — the U.S. might be back close to the force levels of early 2009, before the President’s second surge was launched.  (When Obama entered office, there were only 31,000 U.S. troops in Afghanistan.)

FBI stats say 858,408 people were arrested for marijuana in 2009, under US Atty General Holder’s DOJ,  the 2nd highest total ever, and it was an increase of + 1.3% from under the Bush administration’s last year in office, 2008.  (the record was 872,721 in 2007)

per NORML, arrests for marijuana are more than one half of all drug arrests in the United States, up from 44% 10 years ago.

758,593 were charged with possession only , the remaining 99,815 were charged with sale or manufacture, which includes cultivation.  

People Need To Buck Up

The biggest mistake I see many make when trying to sell the Democrats is to call the prospects stupid, and tell them buying the product is the only way they can stop being stupid, apparently thinking the prospects will immediately reach for their wallets and say “where do I sign”?

Of course, that result only happens in salespeople’s dreams – and is the reason 90 percent of people who go into sales never make any money at the job.

There is also a (real life) tried and true technique in sales and marketing that the democrats could try: the top sales producers in any industry constantly critique themselves and ask themselves “If I’m not getting the results I want to get, what am I doing to get the results I am getting?”

Instead of asking themselves what they are doing to produce the results they are getting (dropping support) – and they are producing those results whether they want to or not – Democrats and their supporters are taking the easy route of blaming the voters (their prospects) and treating the voters as if they are stupid.
