Sweet and Savory Bread Puddings

The savory bread puddings I’ve always made have been Italian strata, casseroles made with cubes or slices of bread, milk, eggs, cheese and vegetables. I was recently introduced to an Alsatian version of a sweet bread pudding, in which the bread is soaked in the milk first, then beaten with eggs, sugar and flavorings, folded with beaten egg whites, and poured into a baking dish over fruit. I loved this technique, because there were no hard, dry edges of bread after baking, so I applied it to my savory bread puddings too (without separating the eggs), and got delicious results. The puddings are moist, with a bonus layer of custard that seeps out of the bread crumbs at the bottom of the casserole dish. The sweet ones, in which the eggs are separated, puff like soufflés.

   You can use baguettes or country bread for these, white or whole-wheat. I tried them with whole-wheat sandwich bread, but the sliced bread didn’t hold the custard as well and the puddings were a bit soggy.

ACA: The Good, the Bad & the Truly Ugly

First, this morning House Majority Leader Eric Cantor (R-VA) made the rounds of talk shows spouting how the Affordable Health Care bill can be repealed with a simple majority in the House and Senate since the bill was passed under reconciliation. Without a filibuster proof majority in the Senate, Ryan Lizza at The New Yorker points out the obstacles for that to happen:

Many Republicans, especially in the blog and talk-radio swamps, would cry, “Use reconciliation!” Readers familiar with the congressional debates of 2009-2010 will remember that this procedure allows certain budgetary measures to pass through the Senate with a simple majority. [..]

But reconciliation wouldn’t work here-the process can only be used for policies that have budgetary effects and a C.B.O. score. Much of the A.C.A., such as the insurance exchanges and subsidies, would fall under these categories. But a lot of it, including the hated individual mandate, does not. Repealing the exchanges and subsides without repealing the mandate and the other regulations and cost controls in the law would create a health-care Frankenstein that a President Romney would be rather nuts to support.

That said, the SCOTUS ruling has some rather complex ramifications and Chief Justice Robert’s ruling was rather sly. First was there are the three bit from SCOTUSblog that Lambert Strether pointed out at Corrente:

First, here’s the reasoning:

   Essentially, a majority of the Court has accepted the Administration’s backup argument that, as Roberts put it, “the mandate can be regarded as establishing a condition — not owning health insurance — that triggers a tax — the required payment to IRS.” Actually, this was the Administration’s second backup argument: first argument was Commerce Clause, second was Necessary and Proper Clause, and third was as a tax. The third argument won.

Second, here are the implications for the role of the State as we have understood it from the New Deal onward; what Phillip Bobbitt would call a change a Constitutional Order:

   The rejection of the Commerce Clause and Nec. and Proper Clause should be understood as a major blow to Congress’s authority to pass social welfare laws.

Third, here is the new Constitutional Order:

   Using the tax code — especially in the current political environment — to promote social welfare is going to be a very chancy proposition.

Chancy or not — and it will be the precariat that suffers mischance, and not the elite, in any case — that’s what they’re going to do.

Next from Scarecrow at FDL News Desk who argues that Chief Justice Robert’s “incoherent decision” will “shackle congress” and “screw millions of uninsured:

In the process, he did violence to constitutional law and logic.  Consider, for example, Robert’s logic on the “mandate.”  In saving the “mandate,” Roberts essentially defined it as not a mandate.  You are not really required to purchase insurance, he noted; instead, you may choose not to purchase insurance and instead pay a minor tax.  As we know, taxing is just a way to collect revenues, a contribution to the common, aggregate costs of public programs.  In this case, the program is paying for many people’s health care through a system of risk/cost sharing.

But if the so-called mandate is not really a mandate but rather an option that can be avoided by paying a tax, and if a legitimate purpose of this tax, as government and amicus briefs argued, is to help cover aggregate costs across a pool of many insured and uninsured people, then what does that do to Robert’s argument about the Commerce Clause?  When arguing about the Commerce Clause, Roberts insists it’s a requirement to purchase a “product,” which forces you to take an action, and thus to engage in commerce when you would not otherwise have done that.  Regulating “inaction” is not permissible, Roberts argues.

But if, as Roberts concludes, the “mandate” is not a mandate, and the tax’s purpose is to help cover pooled costs, and not to buy a “product,” then there is no “mandate” to purchase a “product.”  So no one is forced to engage in commerce as Roberts framed it.  Indeed the “commerce” is already there in the risk sharing system across millions of people, all engaged in commerce by paying premiums into a pooled risk scheme.  Robert’s entire premise for striking down the Commerce Clause rationale is thus contradicted by his argument about how it’s permissible for Congress to enact a tax to support funding of collective health care costs.  That’s what the tax does; but it’s also what paying insurance premiums does.

Roberts’ reasoning on Medicaid is equally illogical. His premise is that Congress cannot expand an existing program administered by states that depends on shared state/federal funding by conditioning funding for the whole program on the states actually implementing the expansion.  As Brad DeLong observes, if Congress were just now creating a fully expanded Medicaid, to be implemented by states but mostly paid for by the feds, there would be no question that Congress could condition federal funding on the states actually carrying out the programs.  But if the program already exists for half the needy population, Congress cannot complete the program for the other half and use the same leverage to achieve the same degree of state cooperation.

As per the CBO, if the states actually implement the expansion and make an effort to get those eligible to sign up, 16 to 17 million more people will have health care coverage. But without that leverage to get the states to accept Medicaid expansion it leaves the poor between around 50% and 133% of the poverty line in a real no man’s land, because they would both be ineligible for Medicaid AND the coverage subsidies in the exchanges.

As for the states voluntarily opting in for the Medicaid expansion, David Dayen doesn’t think that will happen either, even though the cost for the states would only be responsible for less than 10% of the costs.

And being on the hook for even a small amount of funds isn’t going to make any of these governors happy. Heck, here’s a Democrat, former West Virginia Governor and current Senator Joe Manchin, making the argument for them:

   We should all recognize that the health care challenges that many West Virginians and Americans face are not going to go away unless Congress takes additional action to repair this bill. Now that the Court has ruled, we can move forward with fixing what is wrong with this bill and saving what is right. I have always been determined to reduce the burden on states from the Medicaid expansion, and this ruling affirms my position – and makes clear that states must have the flexibility to live within their means by determining Medicaid eligibility as each state sees fit. I have always said one size doesn’t fit all.

That’s going to be a compelling set of logic for a non-trivial number of governors. They’ll also distort how much the expansion would put their states “on the hook.” 26 states sued to eliminate the Affordable Care Act entirely, and they almost got there. Why wouldn’t they jump at the chance to eliminate the portion that creates half of the coverage benefits?

This isn’t going to be universal. New Mexico’s Republican Governor Susanna Martinez, for example, certainly sounds like she’ll take the money. But Southern states in particular, who paradoxically house the citizens most in need of the Medicaid expansion coverage, will be likely resisters at the outset. And it’s not like a lot of success in modern America comes from rallying at the grassroots level for poor and disenfranchised people.

As was noted by Ezra Klein of the Washington Post, opponents of the ACA see this as a win:

“We won,” said Georgetown law professor Randy Barnett, who was perhaps the most influential legal opponent of the Affordable Care Act. “All the arguments that the law professors said were frivolous were affirmed by a majority of the court today. A majority of the court endorsed our constitutional argument about the Commerce Clause and the Necessary and Proper Clause. Yet we end up with the opposite outcome. It’s just weird.”

Yes, it’s weird but so was the whole ACA bill from the very start.

Soups That Taste Like Spring

I wanted comforting food this week that would showcase the wonderful late spring/early summer vegetables that are appearing in markets all over the country right now – great big bunches of chard with wide stems and lush leaves, tender leeks, the last of the fava beans, first of the green beans and the first of the summer squash, still small and delicate. I didn’t have a lot of time, and I wanted to make dishes that I could serve as the main dish for dinners throughout the week, so I did what the French do: I made soup.

Three-Bean Soup

White beans from the pantry and favas and green beans from the market are the basis of a beautiful and hearty dish.

Going Nuts for Smoothies

Strawberry And Almond Smoothie

   When I make a smoothie I like to make a meal out of it, or at least make something substantial enough to get me through my morning swim…. Lately I’ve been adding substance to smoothies in the form of nuts, seeds and nut powders. I recently learned about the benefits of soaking seeds overnight in water.

   Soaking breaks down phytic acid and protease inhibitors, naturally occurring substances in nuts, seeds, grains and legumes that protect them until they germinate but can block enzyme function and reduce the absorption of important minerals in your body. Soaking seeds also breaks down complex starches.

   I found that soaking nuts – almonds and pistachios, in this week’s recipes – leached too much flavor from them, but I liked the results for the sunflower seeds, pumpkin seeds and sesame seeds I used in this week’s blender drinks. Soak seeds overnight in the refrigerator and drain before using. I also recommend this method if you use seeds in your homemade breads: They won’t get hard and burn when you bake the bread, and they’ll help keep the crumb nice and moist.

Layers of Flavor: Lasagna With Roasted Vegetables

Roasting brings a rich dimension to all sorts of vegetables. I’d never thought of roasting broccoli, for instance, but now I’ll be roasting that vegetable as often as I steam it, for sure.  [..]

You can get ahead on lasagna by making up big batches of marinara sauce and freezing it, or in a pinch use a good commercial brand. The noodles are no-boil, which really makes these lasagnas easy to assemble. They make great one-dish meals, and I think they’re very kid-friendly. They can be made ahead and reheated (I’m pulling the leftovers of this week’s recipe tests out of my refrigerator and feeding them to a group of hungry teenagers after a school concert tonight), or frozen.

Lasagna With Steamed Spinach and Roasted Zucchini

This is adapted from a much richer Italian vegetable lasagna recipe. Roasting the zucchini adds a welcome layer of flavor.

Collard Greens, Fast or Slow

If you’re looking for a vegetable that’s a great source of calcium, collard greens are a find. According to the Harvard School of Public Health, a cup of cooked collard greens has more calcium than a glass of skim milk. This is great news for those who don’t eat dairy, and it’s just one of the many health benefits collards have to offer. They’re high in the carotenoids lutein and zeaxanthin, which are important for eye health; they’re very high in vitamins A and C, manganese, folate and dietary fiber; and they’re a good source of potassium and vitamins B2 and B6.

The Seasonal Charms of Green Garlic

   Green garlic has a window of about a month at farmers’ markets in Los Angeles, where I live, and I cannot resist buying it every time I go. At the beginning of the season the bulbs look more like leeks or spring onions than garlic, as they have not yet set cloves. To prepare them I just cut away the stalks as I would a spring onion, cut them in half and remove any tough stalk that might be running down the middle, remove the papery outer layers and chop like a scallion or leek.

   By now the green garlic I’m buying – actually, the bulbs are pink, but the stalks are green – has set cloves. The long green stalk must be cut away and the papery shells and the middle stalk removed. The cloves are juicy and mild, and I am using them in everything from stir-fries to omelets. Some farmers sell garlic scapes, the curly, green flowering end of the garlic plant. I have yet to find them at my market, but you can find recipes at several Web sites, including this one. They can be used in the same way you might use the green parts of scallions – in salads, omelets and pasta dishes, for example. Next year, when I’m ready to write my now-annual green garlic column, I’ll look hard for scapes so I can include some recipes.

You know when I say this I sound hyperbolic.  If I bring stuff like this up I sound like one of those conspiracy loons which nobody is supposed to listen to but ya know in a declining empire of declining industries historizing multi-year employees in any field of human endeavor just makes excellent predatory capitalistic sense.

Pam is prohibited from the possession of her cell phone while on company property.

Pam is not allowed to exit the building during breaks.  

Why is Pam not allowed to exit the building during breaks?

Well the assumption here is that Pam might be exiting the building to have a cigarette, which in this health care oriented industry is a totally verboten concept.  But why.  The cultural concept here has gone way far beyond some concern for the health of Pam but focuses more on the potential cost of potential medical insurance claims Pam might potentially claim in getting cancer on the health insurance plan she could not possibly afford with this asshole company so her husband carries it with his company.  I happen to work with Pam’s husband so I personally know about the calculated gradual degradation  of that health plan.

Her annual raise she did not get for the last two years went towards putting secret Sam surveillance cameras and thumbprint readers to get into the building.  After a  twelve hour night shift this latest piece of corpo-crap calls her five times during the day advising about “available shifts”.  It is a creepy barely understandable computer generated voice giving Pam her “Bingo Numbers” for, big whoop, ten dollars at Dunkin Donuts.  Welcome to the infinite compassion of the health care industry.

Pam, by working for AssholeCorp has legally contractually consented to, according to management dweebs, searches of herself, her pocketbook, her car for lost shit dementia patients have accused her of stealing.

Pam is not allowed to smoke.  She is not allowed to deviate from the interests of the corporation, it’s vendors, clients, attending doctors, UPS delivery guys and or any other people and or policies corporate makes up at will and published on the corporate IT system Pam does not have access to.

One can after all hire pool CNA nursing assistants who don’t speak English, deliberately ignore call lights and up their own self worth by reporting strategically significant talking points to a galactially delusional management.

I can not un-friend un-recommend this formerly premier rehab/nursing home establishment in this supposedly utopian yuppie suburban north of Boston piece of shit place for targeting purposefully and deliberately long term employees to save those health care bucks.

It is after all far easier to exploit women in the workplace than it is to exploit men.  Plus you actually don’t want older people in your workplace as they have that potential tendency to not put up with the neuvo-corporate fascisms of today’s workplace environment.  Ah, you want the very name of this establishment?  Coming real soon.

Turning Up the Heat on Lettuce

   I decided to devote most of the recipes this week to dishes that involve cooking lettuce. I couldn’t resist one simple romaine and radish salad, but the rest of the dishes are cooked. I used the tough outer leaves of romaine or leaf lettuce in blended sauces and entire heads in soups. I tested several classic French braised lettuce recipes, but as promising as these looked on paper, they didn’t appeal to me nearly as much as the more vibrant Chinese stir-fried lettuce dishes I tried, or the puréed soups. In the French braised dishes, the life seemed to be cooked out of the lettuces.

   I used sturdy lettuces like romaine and leaf lettuce for the cooked dishes, not tender spring mixes, which really should be dedicated to salads. Bitter lettuces with tough outer leaves, like curly endive (a k a escarole or chicory) and Batavia, stand up to cooking the same way greens like kale do. Use the recipes not only when you have a surfeit of lettuce in your C.S.A. basket, but also for the tough outer leaves of the one head of romaine in your fridge that you don’t want to include in your salads.

One of the nation’s largest medical debt collectors sneaks into hospitals to seize patients’ money before treatment.

Debt Collector Is Faulted for Tough Tactics in Hospitals

Hospital patients waiting in an emergency room or convalescing after surgery are being confronted by an unexpected visitor: a debt collector at bedside.

This and other aggressive tactics by one of the nation’s largest collectors of medical debts, Accretive Health, were revealed on Tuesday by the Minnesota attorney general, raising concerns that such practices have become common at hospitals across the country.

The tactics, like embedding debt collectors as employees in emergency rooms and demanding that patients pay before receiving treatment, were outlined in hundreds of company documents released by the attorney general. And they cast a spotlight on the increasingly desperate strategies among hospitals to recoup payments as their unpaid debts mount.

Adding Mussel to Your Meal

   I always associated high omega-3 content with fatty cold-water fish like salmon, mackerel and tuna, but it turns out that there are 1,472 milligrams of omega-3s in 6 ounces of mussels (the approximate amount of meat you get from a pound in the shell), only 400 milligrams less than the same amount of salmon.

   Farmed mussels are a much more ocean-friendly seafood choice than farmed salmon…. Look for mussels that are shiny and black, and somewhat heavy for their size. When you get them home, take them out of the wrapping immediately, give them a quick rinse and put them in a big bowl. Cover the bowl with a damp cloth and refrigerate until you’re ready to clean and cook them.
