CIA May Have Spied on Its Overseers

In an article from McCaltchy, it was revealed that the Central Intelligence Agency may have been spying on Senate Select Committee on Intelligence members as they investigated the agency’s involvement and cover up of torture, rendition, and black op prisons. The allegation that the CIA hacked the computers used by committee staffers preparing the 6300 page report has led to the CIA’s Inspector General to request the Justice Department to open an investigation of the SIA’s actions which may have been a violation of an agreement between the committee and the agency.

In question now is whether any part of the committee’s report, which took some four years to compose and cost $40 million, will ever see the light of day.

The report details how the CIA misled the Bush administration and Congress about the use of interrogation techniques that many experts consider torture, according to public statements by committee members. It also shows, members have said, how the techniques didn’t provide the intelligence that led the CIA to the hideout in Pakistan where Osama bin Laden was killed in a 2011 raid by Navy SEALs.

The committee determined earlier this year that the CIA monitored computers – in possible violation of an agreement against doing so – that the agency had provided to intelligence committee staff in a secure room at CIA headquarters that the agency insisted they use to review millions of pages of top-secret reports, cables and other documents, according to people with knowledge.

Sen. Ron Wyden, D-Oregon, a panel member, apparently was referring to the monitoring when he asked CIA Director John Brennan at a Jan. 29 hearing if provisions of the Federal Computer Fraud and Abuse Act “apply to the CIA? Seems to me that’s a yes or no answer.”

Brennan replied that he’d have to get back to Wyden after looking into “what the act actually calls for and it’s applicability to CIA’s authorities.”

At the New York Times, Mark Mazzetti reports:

The origins of the current dispute date back more than a year, when the committee completed its work on a 6,000-page report about the Bush administration’s detention and interrogation program. People who have read the study said it is a withering indictment of the program and details many instances when C.I.A. officials misled Congress, the White House and the public about the value of the agency’s brutal interrogation methods, including waterboarding.

The report has yet to be declassified, but last June, John O. Brennan, the C.I.A. director, responded to the Senate report with a 122-page rebuttal challenging specific facts in the report as well as the investigation’s overarching conclusion – that the agency’s interrogation methods yielded little valuable intelligence.

Then, in December, Mr. Udall revealed that the Intelligence Committee had become aware of an internal C.I.A. study that he said was “consistent with the Intelligence Committee’s report” and “conflicts with the official C.I.A. response to the committee’s report.”

It appears that Mr. Udall’s revelation is what set off the current fight, with C.I.A. officials accusing the Intelligence Committee of learning about the internal review by gaining unauthorized access to agency databases.

Marcy Wheeler explained the lead up to these new revelations:

In January, Ron Wyden and Mark Udall suggested that CIA was hacking into US computers.

   Wyden asked (43;04) John Brennan whether the federal Computer Fraud and Abuse Act applied to the CIA.

       

Wyden: Does the federal Computer Fraud and Abuse Act apply to the CIA?

       Brennan: I would have to look into what that act actually calls for and its applicability to CIA’s authorities. I’ll be happy to get back to you, Senator, on that.

       Wyden: How long would that take?

       Brennan: I’ll be happy to get back to you as soon as possible but certainly no longer than-

       Wyden: A week?

       Brennan: I think that I could get that back to you, yes.

   Minutes later, Mark Udall raised EO 12333′s limits on CIA’s spying domestically (48:30).

     

Udall: I want to be able to reassure the American people that the CIA and the Director understand the limits of its authorities. We are all aware of Executive Order 12333. That order prohibits the CIA from engaging in domestic spying and searches of US citizens within our borders. Can you assure the Committee that the CIA does not conduct such domestic spying and searches?

       Brennan: I can assure the Committee that the CIA follows the letter and spirit of the law in terms of what CIA’s authorities are, in terms of its responsibilities to collect intelligence that will keep this country safe. Yes Senator, I do.

The NYT’s notes that it appears the spying began after the committee members accessed documents that the CIA didn’t want them to see. The next question should be, how did the CIA know what documents were accessed if they weren’t already monitoring the members? What were in those documents that the CIA didn’t want to be seen?

One of the questions that Sen. Udall asked Brennan was if the Computers Crimes and Abuse Act (18 USC § 1030) applied to the CIA. This was part of Brennan’s response

The answer is the statute does apply. The Act, however, does not expressly prohibit any lawfully authorized investigative, protective, or intelligence activity , , , of an intelligence agency of the United States,

It appears not only did the CIA violate the Computer Fraud and Abuse Act, the National Securities Act and EO 12333 but Brennan lied about it to the Senate Intelligence Committee. Why does he still have his job?

US Military Doctors Aided Torture Of Detainees

Primum non nocere, Latin for “first do no harm,” is the fisrt principal precept of medical ethics that all medical students are taught in medical school and is a fundamental principle for emergency medical services around the world. It is part of the oath that physicians take on graduation. It appears that ethical standard was abandoned by military doctors after 9/11 and has continued with the inhumane treatment of detainees and Guantanamo and other black-ops sites around the world. In a report (pdf) from the Task Force on Preserving Medical Professionalism it was concluded that military doctors and psychologists worked with the CIA and the Pentagon to design, enable and participate in torture and cruel, inhumane and degrading treatment

An independent panel of military, ethics, medical, public health, and legal experts today charged that U.S. military and intelligence agencies directed doctors and psychologists working in U.S. military detention centers to violate standard ethical principles and medical standards to avoid infliction of harm. The Task Force on Preserving Medical Professionalism in National Security Detention Centers (see attached) concludes that since September 11, 2001, the Department of Defense (DoD) and CIA improperly demanded that U.S. military and intelligence agency health professionals collaborate in intelligence gathering and security practices in a way that inflicted severe harm on detainees in U.S. custody.

These practices included “designing, participating in, and enabling torture and cruel, inhumane and degrading treatment” of detainees, according to the report. Although the DoD has taken steps to address some of these practices in recent years, including instituting a committee to review medical ethics concerns at Guantanamo Bay Prison, the Task Force says the changed roles for health professionals and anemic ethical standards adopted within the military remain in place.

“The American public has a right to know that the covenant with its physicians to follow professional ethical expectations is firm regardless of where they serve,” said Task Force member Dr. Gerald Thomson, Professor of Medicine Emeritus at Columbia University. “It’s clear that in the name of national security the military trumped that covenant, and physicians were transformed into agents of the military and performed acts that were contrary to medical ethics and practice. We have a responsibility to make sure this never happens again.” [..]

“Abuse of detainees, and health professional participation in this practice, is not behind us as a country,” said Task Force member Leonard Rubenstein, a legal scholar at the Center for Human Rights and Public Health at The Johns Hopkins Bloomberg School of Public Health and the Berman Institute of Bioethics. “Force-feeding by physicians in violation of ethical standards is illustrative of a much broader legacy in which medical professionalism has been undermined.”

Joining Amy Goodman and Juan Gonzalez on Democracy Now! for a discussion of the report are retired brigadier general Dr. Stephen Xenakis, a military psychiatrist who advised the chair of the Joint Chiefs of Staff on military mental health issues, and Leonard Rubenstein, senior scholar at the Johns Hopkins Bloomberg School of Public Health and co-author of the report, “Ethics Abandoned: Medical Professionalism and Detainee Abuse in the ‘War on Terror.’

The two-year study cites doctors for breaching patient confidentiality and advising interrogators on how to exploit prisoners’ fears and crush their will to resist. The task force is calling for a full investigation of the medical profession’s role in U.S. torture and an overhaul to ensure doctors involved in interrogations follow ethical standards. Both the CIA and the Pentagon have rejected the report’s findings.

CIA made doctors torture suspected terrorists after 9/11, taskforce finds

Doctors were asked to torture detainees for intelligence gathering, and unethical practices continue, review concludes

Medical professionals were in effect told that their ethical mantra “first do no harm” did not apply, because they were not treating people who were ill.

The report lays blame primarily on the defence department (DoD) and the CIA, which required their healthcare staff to put aside any scruples in the interests of intelligence gathering and security practices that caused severe harm to detainees, from waterboarding to sleep deprivation and force-feeding.

The two-year review by the 19-member taskforce, Ethics Abandoned: Medical Professionalism and Detainee Abuse in the War on Terror, supported by the Institute on Medicine as a Profession (IMAP) and the Open Society Foundations, says that the DoD termed those involved in interrogation “safety officers” rather than doctors. Doctors and nurses were required to participate in the force-feeding of prisoners on hunger strike, against the rules of the World Medical Association and the American Medical Association. Doctors and psychologists working for the DoD were required to breach patient confidentiality and share what they knew of the prisoner’s physical and psychological condition with interrogators and were used as interrogators themselves. They also failed to comply with recommendations from the army surgeon general on reporting abuse of detainees.

The CIA’s office of medical services played a critical role in advising the justice department that “enhanced interrogation” methods, such as extended sleep deprivation and waterboarding, which are recognised as forms of torture, were medically acceptable. CIA medical personnel were present when waterboarding was taking place, the taskforce says.

US Medical Professionals Were Involved in the Design & Administration of Torture

At Guantanamo Bay, a policy was implemented to allow interrogators to use “medical and psychological information” on detainees in order to “exploit” weaknesses during interrogations. The International Committee of the Red Cross reported in 2004 that military interrogators were able to freely access detainee medical records. Detainee medical information can be used for “intelligence gathering,” and BSCTs are allowed to perform psychological assessments, which are passed on to interrogators, so long as that information is not used to treat a prisoner inhumanely. The Task Force urges this practice be brought to an end.

The Task Force report addresses the role of medical personnel in force-feedings. It does not accept the Defense Department’s claim that force-feedings are undertaken to save lives. They have been “used commonly, not just in rare instances where a detainee’s life was threatened.” They have been explicitly used to break political protests. And, therefore, all force-feedings should be “prohibited.”

Finally, the report proposes that medical personnel be held accountable for their role in torture or inhumane treatment by further informing the public of the role of medical personnel in what has happened. There should be more “fact-finding and investigations” along with “stronger disciplinary action through state health professional licensing boards.”

It suggests that military and intelligence health professionals be subject to the same civilian disciplinary system as other health professionals because, no matter where they are working, all military and intelligence medical personnel are US physicians and psychologists. [..]

In conclusion, while it is not stated by the Task Force, this failure to hold medical professionals accountable should be understood in the context of the larger issue of impunity for those involved in authorizing and carrying out torture in the “war on terrorism” under President George W. Bush. It has been policy under President Barack Obama to decriminalize torture and not prosecute former Bush administration officials responsible for cruel and inhuman treatment. The administration is also presiding over military commissions at Guantanamo that will not permit evidence of torture to be mentioned in court by the very few defendants that have been granted some modicum of due process after actually being charged with committing crimes.

A 6,300-page report by the Senate intelligence committee details the CIA’s role in torture and likely contains critical details on medical personnel’s role in torture yet it remains secret. The CIA has effectively managed to resist or prevent the release thus far and the Obama administration has not taken the step of ordering that it be released in some form, which has enabled the CIA to continue to escape full responsibility for its role in the torture of prisoners.

Blue Ribbon Task Force Says Army Field Manual on Interrogation Allows Torture, Abuse

A report by a multidisciplinary task force, made up largely of medical professionals, ethicists and legal experts, has called on President Obama to issue an executive order outlawing torture and other abusive techniques currently in use in the military’s Army Field Manual on interrogations. The Task Force, which wrote the report for The Institute on Medicine as a Profession (IMAP) and the Open Society Foundations (OSF), has also called on the Department of Defense to rewrite the Army Field Manual in accordance with such an executive order. [..]

Besides recommending that the Department of Defense (DoD) revise the AFM itself, the Task Force report calls for the United States to “accede to the Optional Protocol to the Convention Against Torture, which requires the creation of an independent domestic monitoring body for the purpose of preventing torture against individuals in custody.”

The recommendation to issue a new executive order on current forms of torture and abuse, and to rewrite the Army Field Manual is one of eight findings and numerous recommendations in the report. The first recommendation was for President Obama to “order a comprehensive investigation of U.S. practices in connection with the detention of suspected terrorists following 9/11 and report the results to Congress and the American people.”

The report continued, “The investigation should include inquiry into the circumstances, roles, and conduct of health professionals in designing, participating in, and enabling torture or cruel, inhuman, or degrading treatment of detainees in interrogation and confinement settings and why there were few if any known reports by health professionals.” In the body of the report, the Task Force indicated the investigation should include an examination of the “highly questionable” and “unexplained” use of the drug mefloquine on all the Guantanamo detainees, something I will examine in more depth in a future article.

Doctors: Force-Feedings at Guantanamo Have Been Used to Break Political Protests, Not Save Lives

This year at Guantanamo one of the biggest hunger strikes in the history of the facility took place. Lawyers for detainees reported more than 100 prisoners in the prison were at one point participating in the hunger strike, which aimed to call attention to the inhumanity and hopelessness of their indefinite detention. But the hunger strike, an act of protest, was eventually broken through force-feedings that involved medical personnel.  [..]

A prisoner used to be able to control the rate that food was entering his body to limit discomfort. But, “in a major policy change from the past that adds to the coerciveness of force-feeding, the detainee is no longer permitted to control drip rates or order of ingredients during enteral feeding.” The new standard operating procedure states that giving prisoners this kind of control “has had the effect of prolonging the total time spent in the feeding chair and has given the detainee a measure of control over an involuntary process.” Therefore, the Task Force indicates “all elements

of detainee control over flow rate, content of feeding, or location of feeding is now prohibited.”

Furthermore, the Task Force maintains its conclusions are “consistent with decisions of courts reviewing similar practices. The European Court of Human Rights, while stating that force-feeding to save a life may not amount to a violation of laws against torture and cruel, inhuman, or degrading treatment, held that ‘repeated force-feeding, not prompted by valid medical reasons but rather with the aim of forcing the applicant to stop his protest, and performed in a manner which unnecessarily exposed him to great physical pain and humiliation, can only be considered as torture.'”

These medical professional should not just be barred from practicing medicine anywhere, they should be prosecuted for torture along with all those responsible for the implementation of these programs and policies from both the Bush and Obama administrations.  

The Big Lie: The US Doesn’t Torture

The prisoners on trial before military tribunal at Guantanamo for their attacks on the United States are unable to present evidence that they were tortured by the CIA even though they are facing the death penalty. This is what has been happening:

On Tuesday, October 22, the lawyers for the September 11 accused argued that the Guantanamo military commissions’ protective order (pdf) violates the United Nations Convention Against Torture. The protective order states that the defendant’s “observations and experiences” of torture at CIA black sites are classified. Defense counsel say that this violates the Convention Against Torture’s requirement that victims of torture have “a right to complain” to authorities in the countries where they are tortured, and makes the commission into “a co-conspirator in hiding evidence of war crimes.”

It is not only the defendants’ lawyers who object to the protective order. The ACLU has called the restrictions on detainees’ testimony “chillingly Orwellian.” Earlier this year, the Constitution Project’s bipartisan, independent Task Force on Detainee Treatment (for which I served as staff investigator) found that the military commissions’ censorship of detainees’ descriptions of their own torture could not be justified on grounds of national security, and violated “the public’s First Amendment right of access to those proceedings, the detainees’ right to counsel, and counsel’s First Amendment rights.” This month, the European Parliament passed a resolution that called on the United States “to stop using draconian protective orders which prevent lawyers acting for Guantánamo Bay detainees from disclosing information regarding any detail of their secret detention in Europe.”

The reason the prisoners are being denies their rights to present the evidence of torture, even though they are facing the death penalty, is this:

In April 2009, over the CIA’s objections, Obama declassified four Office (pdf) of Legal (pdf) Counsel (pdf) (OLC) (pdf) opinions that described in graphic detail the brutal techniques that the CIA used against captives after September 11, because in his judgment their release was “required by the rule of law.”

But today, the administration takes the position (pdf) that the release of the OLC memos only declassified the CIA’s use of torturous interrogation techniques “in the abstract.” The details of any individual detainee’s treatment in CIA custody are still top secret. The CIA claims this is necessary because disclosures about individual interrogations would “provide future terrorists with a guidebook on how to evade such questioning,” and “provide ready-made ammunition for al-Qa’ida propaganda.”

The one thing that the defense lawyers, the prosecutors and the judges all agree on, President Barack Obama could fix this.

Biden: Mukasey Stance on Torture “Shocks My Conscience”

Sen. Joe Biden (D-DE) said that he’d been getting the impression that Mukasey really thought about torture in relative terms, and wanted to know if that was so. Is it OK to waterboard someone if a nuclear weapon was hidden — the Jack Bauer scenario — but not OK to waterboard someone for more pedestrian information?

Mukasey responded that it was “not simply a relative issue,” but there “is a statute where it is a relative issue,” he added, citing the Detainee Treatment Act. That law engages the “shocks the conscience” standard, he explained, and you have to “balance the value of doing something against the cost of doing it.”

So basically, while we “do not torture” we have admitted “in the abstract” that we did torture, but if any of those tortured reveal the details of that torture the terrorists of the future will know how we torture and learn how to evade it. So we’re obviously still torturing. Am I missing something?>

Comey Set To Be Confirmed

If anyone, at this point, thinks that President Barack Obama would a change from the Bush administration, his nomination of James Comey to be FBI Director should be proof that any change from the past was a delusion. Besides his record of approving torture, indefinite detention and warrantless wiretapping, at his confirmation hearing Comey defended current US surveillance practices.

Former deputy attorney general who famously rebelled against warrantless spying in 2004 declines to criticise current policy

James Comey, the former US deputy attorney general, said Tuesday that the secret surveillance court that approves wiretapping requests is “anything but a rubber stamp”, even though the so-called Fisa court approves nearly every surveillance request by the government.

“I think folks don’t understand that the FBI operates under a wide variety of constraints,” Comey testified during his confirmation hearing to succeed Robert Mueller as the second director of the bureau since 9/11. The combination of the Fisa court, investigative guidelines from the US attorney general, congressional scrutiny and internal inspectors general are “very effective” at checking FBI abuse, Comey argued.[..]

But Comey declined to criticize the broad, ongoing collection of the phone records when senators asked if they should be scaled back.

Having been out of government since 2005, Comey said that he was “not familiar with the details of the current programs” and did not wish to opine on them. “I do know, as a general matter, the collection and analysis of metadata is a valuable tool in counter-terrorism.”

When questioned about the use of drones, Comey said he did not think drones should be used to kill US citizens in America, but left the door open for cases of “imminent threats.” The precise definition of what circumstances would constitute an “imminent thread” were left unanswered.

Former FBI agent, Colleen Crowley, who was a division legal counsel for 13 years and taught constitutional rights to FBI agents and police, joined Amy Goodman and Nermeen Shaikh on Democracy Now! to discuss Comey’s testimony and inevitable confirmation.

At his confirmation hearing to head the FBI, former Bush administration Deputy Attorney General James Comey refused to criticize the broad, ongoing collection of the phone records of Americans and defended the indefinite detention of U.S. citizens deemed to be enemy combatants. Comey also explained why he signed off on a memo authorizing waterboarding while serving under Attorney General John Ashcroft. We get reaction from former special FBI agent Coleen Rowley, who served with the Bureau from 1981 to 2004. The New York Times just published her op-ed titled “Questions for the FBI Nominee.” In 2002, Time magazine named her and two other female whistleblowers as Time’s “Person of the Year,” for warning about the FBI’s failure to help prevent the 9/11 attacks.

What digbt said: What do you have to do to not be eligible for promotion in official Washington?

I’ve always thought it was a mistake for the administration not to pursue prosecutions for the torture regime. It seems like a bad idea for a powerful nation to ignore war crimes. You have to assume that it could blow back on it some time in the future. But since we now know that the presidency is largely a ceremonial position without any power to shape the debate, affect legislation or influence the military industrial complex, it’s clearly awfully tough to do anything at all. Best stick to nice pictures with foreign leaders and leave it at that.

However, even those who view the office as nothing more than a symbol of leadership would have to grant that the president surely has the discretion not to promote the people who signed off on the war crimes.

Comey’s Torture Advocacy Questioned

Try as President Barack Obama and Attorney General Eric Holder might to denounce torture their actions with the last round of nominees and appointments to crucial positions speak louder than their words. First is was John Brennan to head the CIA, whose dubious record during the Bush/Cheney regime on torture and covering up war crimes was glossed over by Obama. Then there is Director of National Intelligence James Clapper, an inveterate liar who has a memory problem as well, “I forgot the Patriot Act.” Really? Clapper also served as an executive for Booz Allen Hamilton, a private security company contracted to gather data for the NSA, who employed Edward Snowden.

Now, the director of the Federal Bureau of Investigations (FBI) Robert Mueller is retiring and who does Obama choose to replace him? Another Bush crony, James B. Comey, who served as deputy attorney general from 2003 to 2005. Comey, as has been hammered by the Obama administration supporters, blocked, along with Mueller, the Bush administration’s attempt to renew a still secret and illegal surveillance program on Americans’ electronic communications. That incident is only part of Comey’s record at DOJ which includes his support of torture, warrantless wiretapping, and indefinite detention. In her article at The Guardian, Laura Murphy reviews Comey stands on these issues and questions just what illegal surveillance program did Comey oppose so much he would resign over it?

On Torture

On 30 December 2004, a memo addressed to James Comey was issued that superseded the infamous memo that defined torture as pain “equivalent in intensity to the pain accompanying serious physical injury, such as organ failure”. The memo to Comey seemed to renounce torture but did nothing of the sort. The key sentence in the opinion is tucked away in footnote 8. It concludes that the new Comey memo did not change the authorizations of interrogation tactics in any earlier memos.

In short, the memo Comey that approved gave a thumbs-up on waterboarding, wall slams, and other forms of torture – all violations of domestic and international law. [..]

On Warrantless Wiretapping

While, to his credit, (Comey) he immediately began raising concerns (pdf), the program was still in existence when the New York Times exposed it in December 2005. This was a year and a half after Comey’s hospital showdown with Gonzales and Card. In fact, the warrantless wiretapping program was supported by a May 2004 legal opinion (pdf) produced by the Justice Department’s Office of Legal Counsel and signed off by Comey, which replaced the 2001 legal opinion Comey had problems with (pdf).

This, of course, raises the question: just what illegal surveillance program did Comey oppose so much he would resign over it? Last weekend, the Washington Post provided a new theory: the Marina program, which collects internet metadata. Now, the Senate has an opportunity to end the theorizing and find out what exactly Comey objected to.

On Indefinite Detention

The final stain on Comey’s record was his full-throated defense of the indefinite military detention of an American citizen arrested on American soil. In a June 2004 press conference, Comey told of Jose Padilla, an alleged al-Qaida member accused of plotting to detonate a dirty bomb as well as blow up apartment buildings in an American city. By working for al-Qaida, Padilla, Comey argued, could be deprived of a lawyer and indefinitely detained as an enemy combatant on a military brig off the South Carolina coast for the purpose of extracting intelligence out of him

In a letter to Comey, two Democratic senators, Senators Richard J. Durbin of Illinois and Sheldon Whitehouse of Rhode Island, expressed concern on Wednesday about Mr. Comey’s views on waterboarding and his role in approving “enhanced interrogation techniques” while at the Justice Department in the George W. Bush administration. They are asking Comey to explain his e-mail of April, 2005, where he gave his approval of 13 interrogation techniques that included waterboarding.

. . Mr. Comey gave his assent to a Justice Department legal opinion that authorized the C.I.A. to use 13 interrogation methods, including waterboarding and up to 180 hours of sleep deprivation. The opinion “was ready to go out and I concurred,” Mr. Comey wrote to a colleague in an April 27, 2005, e-mail message obtained by The New York Times.

But he said in the e-mail that he disagreed with another legal opinion addressing the “combined effects” of the harsh methods, suggesting that their use in combination might be illegal. He recorded his views in e-mails to Chuck Rosenberg, then his chief of staff, as if deliberately creating a record in case his position might become relevant to his record in the future, as it has.

Appointing Comey to head the FBI is a another slap in the face to voters to whom Mr. Obama promised that he would end the Bush era abuses. Instead, Mr. Obama and his appointees not only continued these programs but covered up the wrong doing of the past, reinforcing and expanding the abuses.

This is what Barack believes.

Now They Tell Us They Didn’t Know Who They Were Killing

As if many of us didn’t know that the CIA didn’t always know who they were dropping hellfire missiles on from drones, NBC News’ Richard Engel and Robert Windrem revealed classified documents that confirmed it. The documents were from a 14 month period that began in 2010 listing 114 drone strikes that killed as many as 613 people. However, in some of those strikes, the CIA did not know the identity of the victims.

About one of every four of those killed by drones in Pakistan between Sept. 3, 2010, and Oct. 30, 2011, were classified as “other militants,” the documents detail. The “other militants” label was used when the CIA could not determine the affiliation of those killed, prompting questions about how the agency could conclude they were a threat to U.S. national security.

The uncertainty appears to arise from the use of so-called “signature” strikes to eliminate suspected terrorists — picking targets based in part on their behavior and associates. A former White House official said the U.S. sometimes executes people based on “circumstantial evidence.”

Three former senior Obama administration officials also told NBC News that some White House officials were worried that the CIA had painted too rosy a picture of its success and likely ignored or missed mistakes when tallying death totals.

Micah Zenko, a former State Department policy advisor who is now a drone expert at the Council on Foreign Relations, said it was “incredible” to state that only one non-combatant was killed. “It’s just not believable,” he said. “Anyone who knows anything about how airpower is used and deployed, civilians die, and individuals who are engaged in the operations know this.”

Ret. Adm. Dennis Blair, who was Director of National Intelligence from Jan. 2009 to May 2010, declined to discuss the specifics of signature strikes, but said “to use lethal force there has to be a high degree of knowledge of an individual tied to activities, tied to connections.”

This article in McClatchy News, found that fewer of than 2% of those killed were Al Qaeda leaders, which is who the U.S. government says it targets.

Obama’s drone war kills ‘others,’ not just al Qaida leaders

“It has to be a threat that is serious and not speculative,” President Barack Obama said in a Sept. 6, 2012, interview with CNN. “It has to be a situation in which we can’t capture the individual before they move forward on some sort of operational plot against the United States.”

Copies of the top-secret U.S. intelligence reports reviewed by McClatchy, however, show that drone strikes in Pakistan over a four-year period didn’t adhere to those standards.

The intelligence reports list killings of alleged Afghan insurgents whose organization wasn’t on the U.S. list of terrorist groups at the time of the 9/11 strikes; of suspected members of a Pakistani extremist group that didn’t exist at the time of 9/11; and of unidentified individuals described as “other militants” and “foreign fighters.” [..]

The documents also show that drone operators weren’t always certain who they were killing despite the administration’s guarantees of the accuracy of the CIA’s targeting intelligence and its assertions that civilian casualties have been “exceedingly rare.” [..]

McClatchy’s review found that:

– At least 265 of up to 482 people who the U.S. intelligence reports estimated the CIA killed during a 12-month period ending in September 2011 were not senior al Qaida leaders but instead were “assessed” as Afghan, Pakistani and unknown extremists. Drones killed only six top al Qaida leaders in those months, according to news media accounts.

Forty-three of 95 drone strikes reviewed for that period hit groups other than al Qaida, including the Haqqani network, several Pakistani Taliban factions and the unidentified individuals described only as “foreign fighters” and “other militants.”

In his speech at the National Defense University in May, President Obama said that his administration “has worked vigorously to establish a framework that governs our use of force against terrorists — insisting upon clear guidelines, oversight and accountability that is now codified in Presidential Policy Guidance” that he had just signed.

Conveniently for the government, that policy guidance remains classified — which pretty much negates the claim about oversight and accountability.

The laws of war allow the United States to kill only members of declared enemy armed forces or civilians directly participating in hostilities. It’s hard to believe the U.S. government is actually following that law if it doesn’t even know who a quarter of the people it’s killing even are.

President Obama’s speech sounded pretty good when he made it, but the more facts trickle out about the drone program the more reason we all have to be skeptical.

What can be done? Human Rights First has set out exactly what steps (pdf) the United States can take to make sure its drone program complies with international law and doesn’t undermine human rights.

The president should start by making public that Presidential Policy Guidance he announced with such pride. Otherwise, neither the American public nor foreign allies or enemies have any reason to believe the U.S. government has reined in its clandestine killing operations at all.

Meanwhile, the White House and the Justice Department says that the assassinations of Americans is constitutional because they said so. At Huffington Post, Ryan J. Reilly reports on the lawsuit,  Al-Aulaqi v. Panetta, filed by the American Civil Liberties Union and the Center for Constitutional Rights on behalf of the estates of Anwwar Al-Aulaqi and his 16-year-old son, Abdulrahman Al-Aulaqi, and Samir Khan. The lawsuit claims that their deaths were unconstitutional because they were denied due process.

The administration’s court filing also claimed that the government deserved qualified immunity because the plaintiffs “failed to allege the violation of any clearly established constitutional rights.” The government maintained that neither Attorney General Eric Holder’s letter to members of Congress nor Obama’s speech on national security had any effect on its legal posture in the case even though it was the first time the government formally acknowledged it had killed the American citizens. The previously classified information disclosed by Obama and Holder is “wholly consistent with Defendants’ showing that Anwar Al-Aulaqi’s due process rights were not violated,” the government said.

The judicial branch, the Obama administration argued, “is ill-suited” to evaluate the myriad “military, intelligence, and foreign policy considerations” that went into the decision to kill the American citizens. The government also argued that because Khan and Abdulrahman Al-Aulaqi were not specifically targeted by the government, they cannot claim they were subjected to an unconstitutional process.

So the Executive Branch is claiming to be judge, jury and executioner because the courts couldn’t possibly understand their reasoning now matter how illegal, unlawful or criminal the actions were because, omg, they were terrorists, maybe. Never mind, that we still don’t know who was targeted that resulted in the killing of Abdulrahman. Maybe if was the cafe owner, one of the other customers or the cousins. No other explanations has been given. That is not acceptable.

So long as the legal arguments for these drone strikes and “targeted” killings remain classified, it makes it damned difficult, if not impossible, to have an open debate in public on the effectiveness and legality of this program and other counter-terrorism programs. The vague statements, filled with nebulous claims are not going to placate the critics of these not so clandestine programs. We need to know what the government is doing in our names.

Time to come clean, Barack.

Guantanamo: Hunger Strike

President Obama renewed his years-old vow to shutter the prison in Cuba after “medical reinforcements” arrived to help force-feed inmates protesting their detention without trial.

At a press conference, Pres. Obama answered questions about the closing of Guantanamo detention center and the hunger strike that started almost a month ago and now involves 100 of the 166 detainees. “I don’t want these individuals to die,” Obama said, “Obviously the Pentagon is trying to manage the situation as best as they can. But I think all of us should reflect on why exactly are we doing this? Why are we doing this?”

Force feeding isn’t the answer, it violates their human rights. In a letter to Defense Secretary Chuck Hagel, the American Medical Association stated that “force feeding of detainees violates core ethical values of the medical profession.”

In the letter (AMA President Dr. Jeremy) Lazarus advised Hagel that the AMA opposes force-feeding a detainee who is competent to decide for himself whether he wants to eat.

“Every competent patient has the right to refuse medical intervention, including life-sustaining interventions,” Lazarus said, adding that the AMA took the same position on force-feeding Guantánamo prisoners in 2009 and 2005.

“The AMA has long endorsed the World Medical Association Declaration of Tokyo, which is unequivocal on the point: ‘Where a prisoner refuses nourishment and is considered by the physician as capable of forming an unimpaired and rational judgment concerning the consequences of such a voluntary refusal of nourishment, he or she shall not be fed artificially.’

The procedure is carried out by corpsmen, enlisted sailors trained to carry out medical procedures, usually supervised by a doctor or a nurse. It is unknown who determines which prisoner is to be force fed. The prisoner is strapped to a chair and his head, arms and legs restrained. A feeding tube is forced through the nose into the stomach and liquid nutrient (Ensure) is poured through the tube. This can be quite painful since it is being done involuntarily.

At any moment in the past months, Obama could have, according to Human Rights First, appointed “a high-level White House official with responsibility to ensure timely and effective implementation of the president’s plan to close Guantanamo.” It has not been done. Obama could have directed the secretary of defense, in “concurrence with the secretary of state and in consultation with the director of national intelligence, to certify detainee transfers and issue national security waivers, to the fullest extent possible consistent with applicable law.” To the public’s knowledge, that has not been attempted.

Obama tied his hand behind his back when the executive branch issued a moratorium on releasing Yemeni prisoners. Ninety of the 166 prisoners in Guantanamo are Yemeni. Twenty-five of the Yemeni prisoners have been cleared for release by Obama’s own review task force he had setup by executive order in 2009.

The Yemen government is demanding Yemeni prisoners be returned to Yemen. Abed Rabbo Mansour Hadi, president of Yemen, has said, “We believe that keeping someone in prison for over 10 years without due process is clear-cut tyranny. The United States is fond of talking democracy and human rights. But when we were discussing the prisoner issue with the American attorney general, he had nothing to say.”

Obama could direct the secretary of defense to initiate Periodic Review Board (PRB) hearings that were supposed to take place to determine if prisoners no longer posed a threat. As HRF described, “The executive order mandated that each detainee shall have an initial review, consisting of a PRB hearing, no later than March 7, 2012. Yet, nearly nine months after the deadline, not even a single PRB hearing is known to have been completed.”

Amy Goodman at Democracy Now! spoke with Carlos Warner, an attorney with the Federal Public Defender of the Northern District of Ohio, who represents 11 Guantánamo prisoners.

“Unfortunately, they’re held because the president has no political will to end Guantánamo,” Warner says. “The president has the authority to transfer individuals if he believes that it’s in the interests of the United States. But he doesn’t have the political will to do so because 166 men in Guantánamo don’t have much pull in the United States. But the average American on the street does not understand that half of these men, 86 of the men, are cleared for release.”

Now, Obama does need Congress’ help to close Gitmo. He needs Congress’ help (though didn’t, when Eric Holder initially decided to try the 9/11 plotters in NY) to try the actual terrorists in civilian courts, to get them in Florence SuperMax in cells down the hall from Faisal Shahzad and Umar Farouk Abdulmutallab, whom he cites.

But most of the detainees at Gitmo won’t ever be tried in civilian courts, either because they were tortured so badly they couldn’t be tried without also admitting we tortured them (and, presumably, try the torturers), or because we don’t have a case against them.

Trying detainees who don’t pose a threat in civilian courts won’t solve the problem as they’re not guilty of any crime.

Moreover, Obama dodges what his Administration has done himself to keep detainees in Gitmo, notably the moratorium on transferring detainees to Yemen and the appeals of Latif and Uthman’s habeas cases so as to have the legal right to keep people based solely on associations and obviously faulty intelligence documents.

Obama doesn’t mention that part of Gitmo’s legacy. Obama says 10 years have elapsed and we should be able to move beyond the fear keeping men at Gitmo.

3 years have elapsed since he issued the moratorium on Yemeni transfers; 19 months have elapsed since he killed Anwar al-Awlaki, purportedly (though not really) the big threat in Yemen. It’s time to move on in Yemen, as well as generally.

Congress may have blocked Pres. Obama from closing the prison, which he signed into law, it didn’t stop him from treating those who are there humanely with dignity, especially those who have been held with no trails because there is no evidence to charge them. But force feeding the hunger strikers because he doesn’t want them to die? Outrageous. How about stop treating those who can be released as prisoners, let them contact their families through the Red Cross. Better yet let those who can go home.

From Spies to Assassins: The CIA Since 9/11

The original mission of the Central Intelligence Agency was to provide national security intelligence assessment to senior United States policymakers. The National Security Act of 1947 established the CIA, affording it “no police or law enforcement functions, either at home or abroad“.

The primary function of the CIA is to collect information about foreign governments, corporations, and individuals, and to advise public policymakers, but it does conduct emergency tactical operations and carries out covert operations, and exerts foreign political influence through its tactical divisions, such as the Special Activities Division.

There has been considerable criticism of the CIA relating to: security and counterintelligence failures, failures in intelligence analysis, human rights concerns, external investigations and document releases, influencing public opinion and law enforcement, drug trafficking, and lying to Congress.

The book’s revelations include disclosing that the Pakistani government agreed to allow the drone attacks in return for the CIA’s assassination of Pakistani militant Nek Muhammad, who was not even a target of the United States. Mazzetti’s reporting on the violence in Pakistan and Afghanistan – and Washington’s response – won him a Pulitzer Prize in 2009. They Did Torture and They Should Be Prosecuted

While we were mostly fixed on the aftermath of explosion at the Boston Marathon, a non-partisan 11-member panel, that had been convened by the  legal research and advocacy group, Constitution Project to look into the treatment of detainees after 9/11, released a 577 page report (pdf) on Tuesday.

The report relying solely on public records, interviews with detainees, military officers and interrogators, concluded that “it is indisputable that the United States engaged in the practice of torture” under the Bush administration:

The use of torture, the report concludes, has “no justification” and “damaged the standing of our nation, reduced our capacity to convey moral censure when necessary and potentially increased the danger to U.S. military personnel taken captive.” The task force found “no firm or persuasive evidence” that these interrogation methods produced valuable information that could not have been obtained by other means. While “a person subjected to torture might well divulge useful information,” much of the information obtained by force was not reliable, the report says.

At emptywheel, Marcy Wheeler points out the report contains a “number of errors, repetition of dangerous misinformation, and incomplete reporting” but it is still important and comprehensive and its conclusion valuable:

Because even this cautious, bipartisan, institutionalist report concludes the following (among other findings):

   Finding #1: U.S. forces, in many instances, used interrogation techniques on detainees that constitute torture. American personnel conducted an even larger number of interrogations that involved “cruel, inhuman, or degrading” treatment. Both categories of actions violate U.S. laws and international treaties. Such conduct was directly counter to values of the Constitution and our nation.

   Finding #2: The nation’s most senior officials, through some of their actions and failures to act in the months and years immediately following the September 11 attacks, bear ultimate responsibility for allowing and contributing to the spread of illegal and improper interrogation techniques used by some U.S. personnel on detainees in several theaters. Responsibility also falls on other government officials and certain military leaders.

   Finding #3: There is no firm or persuasive evidence that the widespread use of harsh interrogation techniques by U.S. forces produced significant information of value. There is substantial evidence that much of the information adduced from the use of such techniques was not useful or reliable.

   Finding #16: For detainee hunger strikers, DOD operating procedures called for practices and actions by medical professionals that were contrary to established medical and professional ethical standards, including improper coercive involuntary feedings early in the course of hunger strikes that, when resisted, were accomplished by physically forced nasogastric tube feedings of detainees who were completely restrained.

   Finding #19: The high level of secrecy surrounding the rendition and torture of detainees since September 11 cannot continue to be justified on the basis of national security.

   Finding #21: The Convention Against Torture requires each state party to “[c]riminalize all acts of torture, attempts to commit torture, or complicity or participation in torture,” and “proceed to a prompt and impartial investigation, wherever there is reasonable ground to believe that an act of torture has been committed in any territory under its jurisdiction.” The United States cannot be said to have complied with this requirement.

The panel was formed after Pres. Barack Obama decided in 2009 not to support a national commission to investigate the post-9/11 counterterrorism programs, as proposed by Senator Patrick J. Leahy (D-VT) and others. “Look forward, not backward”, the president said. included former Senator Asa Hutchinson (R-AL), who served in President George W. Bush’s administration from 2003-2005 as the Under Secretary for Border and Transportation Security in the Department of Homeland Security, and former Representative James Jones (D-OK) who served as the U.S. Ambassador to Mexico from 1993-1997.  Among the other members were a three-star general and former president of the American Bar Association.

Significantly the New York Times article notes this:

The United States is a signatory to the International Convention Against Torture, which requires the prompt investigation of allegations of torture and the compensation of its victims. [..]

While the Constitution Project report covers mainly the Bush years, it is critical of some Obama administration policies, especially what it calls excessive secrecy. It says that keeping the details of rendition and torture from the public “cannot continue to be justified on the basis of national security” and urges the administration to stop citing state secrets to block lawsuits by former detainees. [..]

The core of the report, however, may be an appendix: a detailed 22-page legal and historical analysis that explains why the task force concluded that what the United States did was torture. It offers dozens of legal cases in which similar treatment was prosecuted in the United States or denounced as torture by American officials when used by other countries.

The report compares the torture of detainees to the internment of Japanese Americans during World War II. “What was once generally taken to be understandable and justifiable behavior,” the report says, “can later become a case of historical regret.”

Laura Pitter, counterterrorism adviser at Human Rights Watch, joined Democracy Now‘s Amy Goodman and Nermeen Shaikh to discuss the report,s “indisputable” evidence that the Bush administration tortured.

What Marcy said:

In short: it was torture, it was illegal, it was not valuable, and it still needs to be prosecuted.

Instead, The Justice Department instead chose to prosecute Central Intelligence Agency (CIA) whistleblower John Kiriakou, who refused to participate in torture and helped exposed the torture program. Mr. Kiriakou was sentenced to prison while the torturers he exposed walk free. Nice job, Barack.

Torture at Guantánamo: Lt. Col. Stuart Couch on His Refusal to Prosecute Abused Prisoner

On Sept. 11, 2001, Marine Lt. Col. Stuart Couch’s friend died co-piloting the second plane to hit the World Trade Center. Soon after, Couch became one of the first military prosecutors assigned to the U.S. military base at Guantánamo Bay to prosecute men alleged to have carried out the terrorist plot. He ultimately would refuse to prosecute one detainee: Mohamedou Ould Slahi. “It became clear that what had been done to Slahi amounted to torture,” Couch says. “Specifically, he had been subjected to a mock execution. He had sensory deprivation. He had environmental manipulation; that is, cell is too cold, or the cell is too hot. … He was presented with a ruse that the United States had taken custody of his mother and his brother and that they were being brought to Guantánamo.” Couch says he concluded Slahi’s treatment amounted to illegal torture. “I came to the conclusion we had knowingly set him up for mental suffering in order for him to provide information,” Couch said. “We might very well have a significant problem with the body of evidence that we were able to present as to his guilt.”

The Outlaw In the Oval Office

The word in beltway circles is that President George W. Bush Barack Obama is negotiating with Republicans to provide more information on the lethal attack last year on the American diplomatic compound in Benghazi, Libya in order to insure the confirmation of his nominee for CIA Director, John Brennan, who headed the CIA torture program under the Bush administration. So why you ask is this of any importance? It would seem this new capitulating to Republican whining, as reported in The New York Times is a tactic to hold back the Department of Justice memos authorizing drone attacks:

The strategy is intended to produce a bipartisan majority vote for Mr. Brennan in the Senate Intelligence Committee without giving its members seven additional legal opinions on targeted killing sought by senators and while protecting what the White House views as the confidentiality of the Justice Department’s legal advice to the president. It would allow Mr. Brennan’s nomination to go to the Senate floor even if one or two Democrats vote no to protest the refusal to share more legal memos. [..]

Only after an unclassified Justice Department white paper summarizing the legal arguments was leaked to NBC News this month did the administration make two legal opinions on the targeted killing of American citizens briefly available to members of the Intelligence Committees.

But the documents were available to be viewed only for a limited time and only by senators themselves, not their lawyers and experts.

This news set off a most righteous rants by Esquire‘s Charles Pierce that prompted Glenn Greenwald to tweet:

After reading The New York Times article and Ed Kilgore’s reaction at the Washington Animal, Charles Pierce had this to say about a bad idea that is getting worse:

This is what happens when you elect someone — anyone — to the presidency as that office is presently constituted. Of all the various Washington mystery cults, the one at that end of Pennsylvania Avenue is the most impenetrable. This is why the argument many liberals are making — that the drone program is acceptable both morally and as a matter of practical politics because of the faith you have in the guy who happens to be presiding over it at the moment — is criminally naive, intellectually empty, and as false as blue money to the future. The powers we have allowed to leach away from their constitutional points of origin into that office have created in the presidency a foul strain of outlawry that (worse) is now seen as the proper order of things. If that is the case, and I believe it is, then the very nature of the presidency of the United States at its core has become the vehicle for permanently unlawful behavior. Every four years, we elect a new criminal because that’s become the precise job description.

The previous paragraph was just as bruising.

So much for the pledge of greater transparency made by Pres. Obama in his last State of the Union address:

I recognize that in our democracy, no one should just take my word that we’re doing things the right way. So, in the months ahead, I will continue to engage with Congress to ensure not only that our targeting, detention and prosecution of terrorists remains consistent with our laws and system of checks and balances, but that our efforts are even more transparent to the American people and to the world.

The most worrisome parts of all of this is that these criminal acts by the president, vice president or any of the civil officers of the United States are now the norm, unconstitutional laws that have been passed and unlawful executive orders are acceptable and rubber stamped by the courts. The system of checks and balances no longer exists since Congress has refused to hold the Executive Branch accountable for high crimes and misdemeanors since Ronald Reagan ignored the law with the Iran/Contra affair and literally taken off the table by the Speaker of the House never to be mentioned. Now, Congress and the Courts nonchalantly brush aside the concerns that President Barack Obama has become judge, jury and executioner of American citizens for crimes against the United States that they might commit simply for what they said or for whom they were associated. The proud principles that we cherished have been not merely diminished but dismissed and the Constitution is now just a lovely document that is on display in the National Archive.

Charles Pierce has it only partially right when he said liberals were “criminally naive, intellectually empty, and as false as blue money to the future.” If they aren’t speaking out and standing against this criminal in the Oval Office, demanding that Congress fulfill its sworn duty, then they too are criminals under the law.

Democracy in the United States is on life support with little hope for recovery.

What the CIA Won’t Tell About Rendition and Torture

Since 9/11 and the start of the “Global War on Terror” (GWOT), the US government has denied that the CIA was involved in torture and extraordinary rendition despite the evidence to the contrary. Now the organization Open Society Foundations has released an extensive 216 page report, Globalizing Torture: CIA Secret Detention and Extraordinary Rendition (pdf), that details the clandestine program that extended to 54 countries.

Following the terrorist attacks of September 11, 2001, the Central Intelligence Agency embarked on a highly classified program of secret detention and extraordinary rendition of terrorist suspects. The program was designed to place detainee interrogations beyond the reach of law. Suspected terrorists were seized and secretly flown across national borders to be interrogated by foreign governments that used torture, or by the CIA itself in clandestine “black sites” using torture techniques.

Globalizing Torture is the most comprehensive account yet assembled of the human rights abuses associated with CIA secret detention and extraordinary rendition operations. It details for the first time what was done to the 136 known victims, and lists the 54 foreign governments that participated in these operations. It shows that responsibility for the abuses lies not only with the United States but with dozens of foreign governments that were complicit.

More than 10 years after the 2001 attacks, Globalizing Torture makes it unequivocally clear that the time has come for the United States and its partners to definitively repudiate these illegal practices and secure accountability for the associated human rights abuses.

At FDL‘s The Dissenter, Kevin Gosztola takes “a comprehensive look” at the report and some of its findings:

It makes clear the Obama administration has not chosen to end rendition, the process of essentially kidnapping a person and transferring them  to another country for detention where they are likely to be abused or tortured. The administration has not disclosed policies or practices related to “intelligence transfers” (for example, when the CIA ships individuals to other countries). An executive order Obama signed was “crafted to preserve the CIA’s authority to detain terrorist suspects for short periods prior to ‘rendering’ them to another country for interrogation or trial.” This was a loophole that was designed to make it possible for the CIA to keep certain secret prison sites open. [..]

The report also mentions how the United States has declined to conduct criminal investigations into the CIA’s RDI program. The courts have failed to hold any person from the Executive Branch accountable for abuses associated with the RDI program. “To date, not a single case brought by an extraordinary rendition victim has reached the merits stage in a US court,” the report declares.

Meanwhile, there continues to be reports of secret detentions: in April 2011, the “Associated Press reported that suspected terrorists in Afghanistan were being secretly detained and interrogated for weeks at 20 temporary sites including one run by the military’s elite counterterrorism unit, the Joint Special Operations Command (JSOC), at Bagram Air Base”; in July 2011, “it was reported that the Obama administration had secretly detained and interrogated Ahmed Abdulkadir Warsame, a Somali national, for two months aboard a US Navy ship, after seizing him on international waters between Yemen and Somalia”; Jeremy Scahill of The Nation reported in July 2011 the CIA was using a secret prison “in the basement of Somalia’s National Security Agency (NSA) headquarters; and the Washington Post reported in August 2012 that “three European men with Somali roots were arrested by local authorities in Djibouti, where they were detained and interrogated for months-including by U.S. interrogators-even though no charges were pending against them.”
